BAF pushes for modern apartment law to fix conveyance, governance and redevelopment issues

07 Dec 2025

The Bangalore Apartments Federation (BAF), representing over 1,400 RWAs, has urged the State government to introduce the Karnataka Apartment Ownership and Management Act (KAOMA) in the upcoming Belagavi session. BAF says the outdated 1972 Act no longer meets the needs of Bengaluru's growing apartment communities, leaving many homeowners in a 'legal vacuum.' The proposed law seeks clear transfer of ownership and UDS from builders to buyers, defined rules for forming and running owners' associations, and time-bound mechanisms to resolve disputes on conveyance, maintenance and redevelopment. With no dedicated authority for grievance redressal today, BAF says KAOMA is essential to provide clarity, protect owners' rights and modernise apartment governance across Karnataka.Read more

Government updates highway contract rules to reduce risks for private investors

07 Dec 2025

The government has updated its highway contract rules to make toll-based projects more secure for private investors and lenders. The new framework introduces revenue support when traffic stays below projections, extensions in toll-collection periods to offset demand shortfalls, and reductions in tolling periods when traffic exceeds expected levels. It also allows project buyback if a road becomes over-utilised and ensures debt repayment through concessionaire substitution in case of default. These changes aim to reduce demand-related risks and revive private participation in national highway development.Read more

Jaipur issues sealing notice for illegal renovation of heritage building in Walled City

06 Dec 2025

Jaipur's municipal heritage wing has issued a three-month sealing order for an old building in the Walled City's Chaura Rasta after discovering renovation work being carried out without mandatory approval. The action, taken under the JMC Act 2009, has also restricted access to adjoining shops. Officials reiterated that any repair, alteration or facade change to heritage structures requires prior clearance from the heritage-conservation cell, and violations can lead to sealing or even demolition. The move comes amid growing concern over unauthorised construction and structural modifications across the Walled City. Authorities say the latest action reflects a renewed push to safeguard heritage and improve regulatory compliance.Read more

Himachal Pradesh modifies RERA rules, transfers selection power to Chief Secretary

06 Dec 2025

The Himachal Pradesh state assembly has passed the RERA Amendment Bill amid opposition protests and a walkout. The bill shifts the authority to select the RERA chairperson and members from a committee led by the High Court Chief Justice to one headed by the State Chief Secretary. The new panel will include the Housing Department Secretary and the Law Secretary, with provisions for another senior official to step in if needed. The amendment also replaces the five-year term with a fixed, non-renewable four-year tenure. Opposition leaders argued the change reduces judicial oversight and violates the spirit of the central RERA Act, while the government said it will improve efficiency and speed up appointments.Read more

Fast-track courts and more NCLT benches recommended to ease India's insolvency delays

06 Dec 2025

A parliamentary standing committee has advised the government to set up special fast-track courts and strengthen the National Company Law Tribunal (NCLT) structure to reduce the rising backlog of insolvency cases. With nearly 30,600 matters pending and the average resolution period stretching to 713 days, the committee believes additional benches and procedural changes are needed. It noted that quicker resolutions could help creditors recover INR 3-5 lakh crore by preventing value loss in stressed assets. The committee also proposed changes for homebuyers, SMEs, cross-border cases and the overall IBC process.Read more

06 Dec 2025

The Enforcement Directorate (ED) has provisionally attached 19 immovable properties spread across Anjuna, Assagao and Ucassaim in North Goa, covering more than five lakh square metres and valued at about INR 1,268.6 crore. The action, undertaken earlier this week under the Prevention of Money Laundering Act (PMLA), follows ongoing investigations into an alleged land-grab network. Earlier actions by the ED had included freezing bank accounts and other assets worth INR 12.8 crore.Read more

Tribunal clarifies CoC's sole authority to pick liquidator under IBC framework

05 Dec 2025

The NCLAT has ruled that only a Committee of Creditors (CoC) can choose the liquidator in cases where the resolution professional (RP) does not consent to continue in that role. The tribunal set aside two NCLT orders that had directly appointed liquidators, stating that such appointments exceeded the NCLT's authority. Under the Insolvency and Bankruptcy Code, an RP becomes liquidator only with written consent; if not, the NCLT may replace the RP, but the CoC must propose the new liquidator. The ruling also overturns a 2023 regulatory circular restricting RPs from becoming liquidators, reaffirming that statutory provisions prevail and that creditors must have the final say.Read more

Punjab RERA directs developer to hand over long-delayed SCO unit after decade-long wait

05 Dec 2025

Punjab RERA has ordered a Mohali-based developer to hand over possession of a long-delayed SCO unit in Sunny Enclave after the buyers waited nearly a decade despite having paid the entire consideration and completing all formalities. The allottees, who booked the unit in the early 2010s and even registered the conveyance deed years ago, had been denied possession because the project remained unfinished and mandatory occupation-related approvals were never issued. Acting on the buyers' complaint, RERA directed the promoter to hand over possession within three months and pay interest for the prolonged delay.Read more
