The website www.Prop News Time.com (“Site”) is owned and operated by Prop News Time (“PNT”) (a sole proprietorship of Mr. Abhay Rao), with its registered office at C- 449, Oshiwara Industrial Centre, Goregaon (W). Mumbai – 400104. The company is registered with RERA under the name of the sole proprietor Mr. Abhay Rao, with the registration number A51800014484.

Any and all use of this website is subject to and constitutes acknowledgement and acceptance of the following terms and conditions (“Terms”). It is mandatory for all Users of the Site to have carefully ready, understood and be in total agreement with the below mentioned Terms before they proceed to use any of the services of the Site (“Services”) and / or access any material, communications, calculators, tools, links and information contained on the Site, including any property listing (“Content”), prices, notices, announcements and disclaimers available on the Site or otherwise provided through the Site.

The term “you” and “your” refer to the person accessing or using the Site, Content and / or Services. The Services are available only to those individuals, companies or firms who have capability of forming legally binding contracts under the Indian laws. You warrant that you are at least 18 years old or are accessing or using the Site and Content under the supervision of a parent or guardian who agrees to the Terms.

These Terms also apply to any mobile applications, other software (including interfaces) that we provide or make available to you. In this instance, a reference to the Site is taken to include each such item. Prop News Time may choose to amend this version of the Terms at any point, at their own discretion. This amended version shall automatically be deemed effective upon going live on the Site.

A User

For the purpose of this Agreement, a “User” is any individual who accesses the Site for whatever purpose, regardless of whether the said User has registered with Prop News Time as a registered user or said User is paying PNT for a specific service being provided by them. A User also includes all legal entities which maybe be represented by the User under actual or apparent authority.

An individual who does not possess the legal or contractual right to access the Site, Content and Services but does so will fall within the definition of an “unauthorized User” and will be subject to the terms and conditions, expressed so with respect to respecting the intellectual property rights of the provider and abiding by the licensing terms and conditions. If a User is covered by RERA, you shall ensure all necessary compliances are met with, including but not limited to obtaining necessary registrations.

As a User, you must not:

Access or use the Site or Content (in whole or part) – (i) For any purpose other than as expressly permitted in these Terms and Conditions, (ii) To engage in any commercial activity, including marketing, advertising, or commercial promotion of products or services, resale, collection of use of any product lists or pricing for the benefit of other individuals (without PNT’s prior written agreement), & (iii) in any unlawful way or for unlawful purposes.
Disrupt or interfere with the Website in any way.
Download (other than page caching), modify, disrupt or interfere with Site or any portion of the Site in any way.
Facilitate or encourage the breach of any of the Terms and Policies (including PNT’s “Privacy Policy”) in any way.
Post unauthorized commercial communications (such as spam) via the Site
Transmit and / or post any obscene or offensive content of any kind. On becoming aware of any User / Individual / Entity doing the same, you must contact us by clicking on the “Feedback” button at the footer of every page.
Collect Content or other information through the use of automated means such as harvesting bots, robots, spiders, or scrapers, without PNT’s prior written permission through or in connection with the Site
Impersonate or falsely claim to represent another person or organization
Do anything misleading, malicious, or discriminatory through the Website
Attempt to gain unauthorized access to any user accounts or computer systems or networks used in connection with the Site
Sell, rent, lease, transfer, sub-license, provide services, distribute or otherwise provide a copy of the Content to a third party for any reason
Modify or create derivative works of the Website or Content;
Challenge the validity of our rights in and to the Website;
Use Content, or post User Material, or take any action in respect of Content, in each case, that may or will infringe or violate the rights of a third party or that may or will otherwise violate any applicable laws (including court orders)
Allow or permit others, directly or indirectly, to perform any of the actions referred to in paragraphs (a) to (n).

Disclaimer & Liability

You acknowledge and agree you access and use the Site and Content entirely at your own risk. You are responsible for obtaining and maintaining your own facilities, hardware, infrastructure and software, and any internet and telecommunications systems, required by you to access and use the Site, and for ensuring that they are compatible with the Site. You are responsible for backing up the devices you use to access the Site, including any content obtained through the Site.

To the full extent permitted by law, Prop News Time excludes all guarantees, terms, representations or warranties that would otherwise arise or be implied by law in relation to the Site, the Content and any supply of goods or services under these Terms and Conditions, including any guarantees, terms, warranties or representations concerning:

The availability of the Site and Content
The quality, completeness, accuracy or suitability of the Site or Content
Products or services advertised or accessible on the Site
The safety of the computer systems of Users
Title to any property advertised on the Site

For any liability that cannot be excluded, but which can be limited, PNT limits its liability to only supplying the relevant services again.

Indemnity

You indemnify Prop News Time, its officers, directors, employees and sub-contractors (“indemnities”) in respect of all loss, damage, costs, expenses (including legal fees on a full indemnity basis), fines, penalties, claims, demands and proceedings howsoever arising, whether in contract, tort (including negligence) or under statute, that may arise out of, result from, or may be payable by virtue of, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by such User pursuant to these Terms. Further, every User agrees to hold the Indemnities harmless against any claims made by third party due to, or arising out of, or in connection with, such User’s use of the Site or Services, User’s violation of the Terms, or User’s violation of any rights of another, including intellectual property rights. The limitations and exclusions in this Section apply to the maximum extent permitted by applicable laws.

Copyright Issues

The Site shall not be liable for any information or data which is not within its knowledge / acknowledgement / contraventions / copy right issues committed by its Users and which is beyond the control of verification. PNT can at their sole discretion, delete any User’s Content is the same is found to be in infringement of the various copyright intellectual property right rights of a third party. That the present clause is in compliance with the Information Technology Act 2000, and hence no dialogue shall be entertained in any case or circumstance.

Copyright Infringement

Our policy is to comply with all Intellectual Property Laws and to act expeditiously upon receiving any notice of claimed infringement. If you believe that any work has been reproduced on this website in a manner that constitutes copyright infringement, please provide a notice of copyright infringement containing all of the following information:

A physical or electronic signature of a person authorized to act on behalf of the copyright owner for the purposes of the complaint.
Identification of the copyrighted work claimed to have been infringed.
Identification of the material on our website that is claimed to be infringing or to be the subject of infringing activity.
The address, telephone number or e-mail address of the complaining party.

Suspension & Termination

Prop News Time, may with or without notice or liability to a User and at their sole discretion:

Change or remove any Content or information that is provided or made available through the Site, including those it believes is in violations of the Terms and Policy.
Change, withdraw, suspend or discontinue the Site or any functionality or feature of the Site and / or
Maintain, delete or destroy all Content and materials provided or made available through the Site.

PNT may at any time immediately suspend or terminate your account and / or your access to the Site at its sole discretion and without prior notice, including if, PNT, in its reasonable opinion, considers you have breached these Terms and Conditions or are no longer an active holder.

By accepting the above-mentioned Terms and Conditions, you agree and expressly state that you are solely responsible for the accuracy and completeness of the registration data and any other information given to PNT in order to use the Services and access its Content.

Website Content

This Website is solely for your personal, non-commercial use. Except as provided below, you must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by e-mail or other electronic means and whether directly or indirectly and you must not assist any other person to do so. Without the prior written consent of the Company, modification of the materials, use of the materials on any other web site or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks and other proprietary rights, and is prohibited. Any use for which you receive any remuneration, whether in money or otherwise, is a commercial use for the purposes of this clause.

While you may occasionally download and store stories from the Website for your personal use, you may not otherwise provide others with access to such stories. The foregoing does not apply to any sharing functionality we provide through the Website that expressly allows you to share stories or links to stories with others. You may not access or view the Services with the use of any scripts, extensions, or programs that alter the way the Services are displayed, rendered, or transmitted to you without our written consent. As a general rule, you may not use the Content, including without limitation, any Content made available through one of our RSS Feeds, in any commercial product or service, without our express written consent.

You agree not to use the Services for any unlawful purpose. We reserve the right to terminate or restrict your access to the Website if, in our opinion, your use of the Services may violate any laws, regulations or rulings, infringe upon another person's rights or violate these Terms.

The Site and/or the Services are controlled and offered by Company from its facilities in the territory of India. Company makes no representations that the Site or Services are appropriate or available for use in other locations. If you are accessing or using the Site or Services from other jurisdictions, you do so at your own risk and you are responsible for compliance with local law. Notwithstanding the foregoing, the Site or Services may contain or provide links to content hosted on website located outside of India.

The information presented on this Website has been compiled by the Company from various sources including from external sources. No representation is made or warranty given as to the completeness or accuracy of such information. This Website may contain typographical errors, incomplete or out of date information. The Company reserves the right to make changes to the Content, Contributed Content and information on this Website, or to the services described therein, or update such information at any time without notice, but the Company makes no commitment to correct or update this information.

Subscription

Subscription services include access to behind the pay-wall content ("Subscription Services"). The nature of content made available to you is subject to change, the final decision of which lies with the editor of the Website. The Company may vary the access rights of users engaged in accessing the Website without a paid subscription at any time at the Company's sole discretion. With respect to paid subscribers, any revision of access rights will take effect on the completion of such user's current subscription term.

Subscription Services may differ geographically and based on the device from which you subscribe. Subscriptions packages and price may also vary in time. The Company reserves the right to introduce new subscription packages from time to time.

The Company will try to process your subscription promptly but does not guarantee that your subscription will be activated by any specified time. By submitting your payment and other subscription details, you are making an offer to us to buy a subscription. Your offer will only be accepted by us and a contract formed when we have successfully verified your payment details and email address, at which point we will provide you with access to your subscription. The Company reserves the right to reject any offer in its discretion, for any or no reason.

Payment Terms

The subscription fees and any other charges due from you in connection with your subscription for the Subscription Services (including any applicable taxes) shall be as per the rates in effect at the time at which it is charged ("Subscription Fees").

When you purchase a subscription with the Website, you must provide us with complete and accurate payment information. By submitting payment details, you promise that you are entitled to purchase a subscription using those payment details. If we do not receive payment authorization or any authorization is subsequently cancelled, we may immediately terminate or suspend your access to your subscription. In suspicious circumstances we may contact the issuing bank/payment provider and/or law enforcement authorities or other appropriate third parties. If you are entitled to a refund under these terms and conditions, we will credit that refund to the card or other payment method you used to submit payment, unless it has expired in which case, we will contact you.

The Company uses the services of third-party payment service providers to process your payment of the Subscription Fees. Accordingly, your usage of such third party services shall be in accordance with the terms and conditions of adopted and implemented by such service provider, and the Company shall not be responsible for any failed or incomplete fulfilment of any payment instructions issued by you through such service provider or any actions taken by the Company in respect of the same.

Subscription Fees will be billed at the beginning of your subscription and any renewal of your subscription. As a general matter, all our fees and charges are non-refundable. We reserve the right to issue refunds or credits at our sole discretion. If we do issue a refund or credit, we are under no obligation to issue the same or similar refund in the future. We may change the Subscription Fees and charges then in effect or add new fees or charges which will take effect that the end of your subscription period, by giving you notice in advance and an opportunity to cancel. If you believe someone has accessed the Website using your account and password without your authorization, please immediately us at info@propnewstime.com.

Term, Renewal, Cancellation

You can choose a subscription of the term and duration offered by the Company as listed in the schedule of Subscription Fees referenced above. These Terms shall remain in full force and effect while you use the Services. Your subscription will renew automatically until it is cancelled in accordance with this section. For all subscriptions, you must cancel your subscription before it renews in order to avoid billing of subscription fees for the renewal term. Subscription to the Website commences immediately on the realisation of payment of the Subscription Fees, and there can be no cancellation once the subscription is active.

You do not have any right to cancel your subscription or any part of it until the end of your then current subscription period. Although you may notify us of your intention to cancel at any time, such notice will only take effect at the end of your then current subscription period, and you will not receive a refund. You may notify us of your wish to cancel your subscription by contacting our team at info@propnewstime.com. You must provide at least 5 business days advance notice for this to be implemented.

The Company reserves the right to suspend or terminate your subscription if you breach these Terms, with or without notice and without further obligation to you. We may also suspend or terminate your subscription if we are prevented from providing Services to you by circumstances beyond our control. The Company may, in exceptional circumstances, cease to publish the Website, the Website content or cease to provide subscription Services. The Company will give you at least 15 days' notice of this, if possible. If we do so, then we will have no further obligation to you except for a refund of the unexpired period of your paid subscription.

If you are a registered user, but not a subscriber, then the Company reserves the right to suspend or terminate your registration at any time, with or without notice and without further obligation to you. In addition to any subscription fees you pay, you are responsible for paying any internet connection or other telecommunications charges that you may incur by accessing the Website or using the Services available on it.
