The Maharashtra Real Estate Regulatory Authority (MahaRERA) has ordered the promoters of the Kalpataru Yashodhan project in Andheri West, Mumbai, to refund more than INR 1.4 crore to a homebuyer couple, along with interest, after the developer failed to deliver possession within the agreed timeframe and illegally forfeited the amount paid. The couple had booked a flat in 2017 and paid approximately INR 1.46 crore, about 20 per cent of the total consideration, for a property worth around INR 7.12 crore. When possession was delayed beyond the promised date, the promoter issued demand letters prematurely and eventually forfeited the payments, later selling the same unit to a third party. MahaRERA ruled that forfeiture under these conditions was arbitrary and violative of provisions of the Real Estate (Regulation and Development) Act, and that the buyers retained statutory protection regardless of the absence of a registered sale agreement.Read more

The Allahabad High Court has dismissed review petitions filed by the Yamuna Expressway Industrial Development Authority (YEIDA) in a long-running land dispute with Silverline Furnishing and Furnitures Pvt Ltd, reaffirming its earlier ruling that directs YEIDA to hand over physical possession and execute lease formalities for a township plot in Greater Noida. The dispute centres on a roughly 100-acre parcel in Sector 18 originally allotted under a 2011 scheme, where YEIDA had failed to deliver physical possession despite collecting premium payments and related fees. The division bench found no apparent on the face of the record in its November 2023 judgment and noted that YEIDA's review pleas sought to re-argue merits beyond the limited scope of review jurisdiction. The Maharashtra government has tightened norms under the Pradhan Mantri Awas Yojana (Urban) 2.0, requiring certain affordable housing projects to secure confirmed beneficiary linkage for at least 25 per cent of units before physical construction can begin or scheme benefits are availed. The directive, issued on 23 January, applies to Affordable Housing in Partnership (AHP) and AHP-public private partnership (AHP-PPP) projects where the sale price of Economically Weaker Section (EWS) units exceeds the applicable annual statement of rates by more than 20 per cent. Under the revised framework, developers must ensure that one in four units has committed beneficiaries before moving ahead with construction or accessing incentives such as additional floor space index. The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) resolved more than 11,300 homebuyer disputes during the calendar year 2025, facilitating relief of approximately INR 2,040 crore, according to data released by the authority. A mix of enforcement actions, mutual settlements and conciliation mechanisms were used to resolve complaints mostly related to delayed possession, refunds and interest claims. UP-RERA issued over 6,000 recovery certificates against defaulting promoters, enabling district administrations to recover around INR 1,505 crore and transfer the amounts directly to allottees bank accounts. Promoters also settled an additional INR 535 crore in around 1,734 cases through negotiated agreements after recovery certificates were issued. The authority's conciliation forum and voluntary compliance by developers further contributed to dispute resolution, covering cases involving properties valued at an estimated INR 5,920 crore.Read more

The Punjab and Haryana High Court has temporarily stayed the Municipal Corporation of Manesar's order to shut and dismantle UltraTech Cement's ready-mix concrete (RMC) plant in Naurangpur village, Gurgaon. UltraTech challenged the directive, citing over two decades of lawful operations and valid statutory approvals, including change of land use and building plan permissions from 1998, as well as a green-category consent to operate from Haryana State Pollution Control Board in 2024. The Maharashtra government has scaled down the new building being constructed inside the Mantralaya compound in south Mumbai following concerns raised by the Mumbai Heritage Conservation Committee (MHCC) over its height.
