Odisha government issues SOP for apartment registration to streamline processes and improve transparency

Synopsis

The Government of Odisha has introduced a Standard Operating Procedure (SOP) for apartment registration to streamline and bring greater transparency to property transactions across the state. The SOP categorises registrations into pre-RERA resale units, first sale of unsold pre-RERA apartments, and post-RERA projects, each with defined documentation and verification requirements. Aligned with the Odisha Apartment (Ownership and Management) Act, 2023 and the Real Estate (Regulation and Development) Act, 2016, the move aims to reduce procedural delays, minimise disputes, and create a more predictable registration framework for homebuyers, promoters, and authorities.

The Government of Odisha has introduced a Standard Operating Procedure (SOP) for apartment registration, aiming to bring greater transparency, uniformity, and efficiency to property registration processes across the state. The move is expected to significantly reduce procedural confusion and streamline how apartment transactions are handled, particularly in cases involving older housing projects and multi-phase developments. 
Under the new framework, apartment registrations have been classified into three clear categories. The first category includes resale transactions of apartments constructed before the implementation of the Real Estate (Regulation and Development) Act, 2016. The second category covers the first-time sale of unsold units in pre-RERA projects. The third category applies to apartments developed under post-RERA regulations. By introducing this classification, the government seeks to ensure that each type of transaction follows a clearly defined and standardised procedure. 
One of the key objectives of the SOP is to address persistent challenges in pre-RERA housing projects, where documentation gaps, inconsistent approvals, and unclear ownership records have often led to delays and disputes. The new system introduces uniform documentation requirements and verification protocols for each category, reducing ambiguity and ensuring that all stakeholders follow the same procedural framework during registration. 
The SOP has also been aligned with the Odisha Apartment (Ownership and Management) Act, 2023, which governs ownership rights, maintenance responsibilities, and management structures within apartment complexes in the state. Additionally, it complements the Real Estate (Regulation and Development) Act, 2016, which was introduced to regulate the real estate sector and protect homebuyer interests at the national level. This dual alignment ensures that the registration process is legally sound while also being administratively efficient. 
Another important feature of the SOP is its focus on reducing disputes among homebuyers, developers, and landowners. By standardising documentation requirements and verification procedures, the government aims to eliminate inconsistencies that often lead to legal conflicts. This is expected to improve trust in the property registration system and facilitate smoother transactions. 
The SOP also introduces clearer procedural timelines and strengthens scrutiny mechanisms to ensure that submitted documents are properly verified before approval. This is expected to help reduce delays that have traditionally slowed down apartment registration in several parts of Odisha. Officials believe that a more structured system will help improve efficiency at sub-registrar offices and reduce the backlog of pending cases. 
Overall, the introduction of the SOP marks a significant step in Odisha’s efforts to modernise its housing governance framework. By creating a uniform and transparent registration system, the state aims to improve accountability, reduce procedural bottlenecks, and ensure a more predictable experience for all stakeholders involved in apartment ownership and transfer.
