The dispute dates back to 2012, when the buyer invested in a residential apartment being developed by the company. After receiving an allotment, the purchaser continued to wait for construction to progress and possession to be handed over. However, despite the passage of several years, the apartment remained unavailable, leaving the buyer without either a completed home or a clear timeline for delivery.
Unable to secure a satisfactory resolution directly from the developer, the buyer approached the Gautam Buddh Nagar District Consumer Disputes Redressal Commission seeking a refund and compensation. During the proceedings, the commission examined the transaction records, payment details and the circumstances surrounding the prolonged delay before arriving at its decision.
The commission observed that purchasing a home represents one of the largest financial commitments made by most families and that buyers are entitled to expect timely fulfilment of contractual obligations. It held that allowing a purchaser to remain in uncertainty for over a decade without possession constituted a clear failure in service and caused unnecessary financial hardship as well as emotional distress.
As part of its order, the commission directed Ansal Hi-Tech Townships to refund the amount deposited by the complainant along with interest calculated from the dates of payment. In addition to the refund, the developer has been instructed to compensate the buyer for the mental agony suffered during the prolonged wait and reimburse litigation expenses incurred while pursuing the case.
The verdict reflects a broader judicial trend that has emerged in recent years, where consumer courts have increasingly prioritised the interests of homebuyers affected by stalled or delayed housing projects.
