The Supreme Court has ruled that renting or leasing a residential flat does not automatically disqualify a homebuyer from being treated as a consumer under the Consumer Protection Act, 1986. The court said consumer status can only be denied if it is clearly proven that the property was bought mainly for commercial purposes. The ruling came while overturning an NCDRC order that had dismissed a complaint solely because the flat was rented out. The court clarified that the burden of proving commercial intent lies with the developer, not the buyer. Since no such evidence was established, the homebuyer's complaint has been restored for fresh hearing.Read more

The National Highways Authority of India has confirmed significant subsidence at one of the piers of the Moothakunnam Kottappuram bridge on NH-66 in Kerala. An inspection by an independent engineer recorded a settlement of around 500 mm. The project is being executed under a hybrid annuity model, making the concessionaire responsible for design and safety. NHAI has ordered a detailed technical investigation and corrective measures at the concessionaire's cost, while also approving INR 11.59 crore for maintenance of the adjoining highway stretch.Read more

The Department of Town and Country Planning (DTCP) has stopped the registration of sale, lease and conveyance deeds for a commercial colony in Gurugram's Sector 53 after finding that the project licence had expired and was never renewed. The licence, issued in 2002 for nearly 3.95 acres, lapsed in 2005. DTCP also noted unpaid statutory dues of about INR 87.6 lakh. Enforcement authorities have directed revenue officials to flag violations and asked police to initiate legal action against the developers.Read more

Kerala has approved a Regional Rapid Transit System connecting Thiruvananthapuram and Kasaragod over 583 km, aiming to enhance mobility and regional development. The project will mostly use elevated tracks to reduce land acquisition and environmental disruption and will integrate with existing and proposed metro networks. A Mumbai special court has discharged DHFL from an INR 5,050 crore money laundering case, granting it statutory immunity under the Insolvency and Bankruptcy Code following its resolution and acquisition by the Piramal Group. The court held that once an IBC resolution plan is approved, the corporate debtor is protected from liability for past offences. However, the immunity does not apply to individuals involved in the alleged wrongdoing. The Nashik Municipal Corporation (NMC) has asked property owners in the city to verify their property tax assessment details and submit objections, if any, by March 10. The civic body has opened property registers for public inspection at its six divisional offices. Around 5.90 lakh properties are currently on record. NMC has clarified that objections will be accepted only after all pending property tax dues are cleared. The Maharashtra Housing and Area Development Authority has approved the redevelopment of four structurally unsafe transit buildings in Sion's Pratiksha Nagar, affecting 261 resident families and four commercial units. The decision follows a structural audit by IIT Bombay that recommended complete reconstruction. MHADA has scrapped an earlier plan to build middle-income group sale housing at the site and will instead construct two high-rise transit buildings with 322 tenements.
