Tamil Nadu mandates online registration for first-sale plots and flats

Synopsis

The Tamil Nadu Registration Department has made its ‘Anywhere Registration’ system mandatory for the first sale of plots and flats from August 17, removing the requirement for buyers, builders and developers to visit Sub-Registrar Offices for these transactions. The first phase covers first-sale plot registrations by developers, along with the corresponding deposit of title deeds, and first-sale apartment registrations by builders with linked mortgage documents. Applicants must create dedicated portal logins, upload Aadhaar details, complete fingerprint or iris-based authentication, submit photographs and make payments online. The initiative is intended to reduce physical footfall at registration offices, improve transparency and distribute workloads more evenly. The state has also amended provisions under the Registration Act, 1908, to provide legal validity to digitally registered documents.

The Tamil Nadu government has made online, presence-less registration mandatory for the first sale of plots and flats from August 17, allowing builders, developers and buyers to complete the specified property transactions without physically visiting a Sub-Registrar Office. The move, implemented under the Registration Department’s ‘Anywhere Registration’ initiative, is intended to reduce congestion, improve transparency and make property registration more accessible across the state. 
Under the first phase, the mandatory online process covers the first sale of a plot by a plot promoter, together with the consecutive deposit of title deeds, and the first sale of a flat by a builder, along with the associated deposit of title deeds. The government’s July 7 order authorised the Inspector General of Registration to mandate these two categories through the presence-less mode once the required software readiness and stakeholder capacity-building measures were completed. 
Builders and land developers are required to create dedicated login credentials on the Registration Department’s portal and submit the relevant documents electronically. Details of the executants, claimants and witnesses, including Aadhaar information, have to be uploaded. Identity verification is completed through Aadhaar-linked biometric authentication using fingerprints or iris scans, while photographs of the parties and witnesses are also captured. Payments and document submission are completed online. 
The process also provides for online communication between applicants and the registering authority. Where a Sub-Registrar seeks additional information, applicants can provide the required clarification through the portal within 30 days. Once approved, the registered document carrying the Sub-Registrar’s digital signature, along with the fee receipt, is to be issued electronically on the same day or the next working day. The registered documents can subsequently be downloaded for up to 60 days. 
To provide legal backing to the system, the state has amended Rules 32, 52 and 69 under the Registration Act, 1908, and introduced rules giving legal validity to digitally registered documents. The online registration framework has also been developed under the Registration (Tamil Nadu Amendment) Act, 2021 and the state’s e-Registration Rules, which provide for electronic presentation of documents. 
The government expects the system to reduce the number of people visiting Sub-Registrar Offices by about 30%, while helping distribute workloads between offices and reducing waiting time. A dedicated help centre is also being established to assist users with technical and procedural issues. The stated technical requirements include an internet connection, UIDAI-approved L0 or L1 fingerprint equipment with an iris scanner and a webcam. 
The rollout forms part of the Registration Department’s wider digitisation programme, which has progressed from the STAR platform to STAR 2.0 and is moving towards the STAR 3.0 ecosystem. The department had also undertaken capacity-building programmes for banks, document writers and other stakeholders before the mandatory implementation. 
The state has simultaneously taken administrative measures within the registration department. Since the government assumed office on May 10, it has transferred 259 Sub-Registrars, filling vacancies in 249 Sub-Registrar Offices and staffing 10 administrative Sub-Registrar posts. The government said the postings were based on employee requests and administrative requirements, with permanent officers placed in high-revenue and high-volume registration offices.
