The Lucknow bench of the Allahabad High Court has asked the Uttar Pradesh government to examine the feasibility of creating a grievance redressal mechanism for disputes between apartment owners and Residents’ Welfare Associations (RWAs). The observation came while hearing a petition concerning residents of Sarvodaya Sulabh Apartments in Gomti Nagar Extension, Lucknow. The court noted that while apartment associations have an important role in managing residential societies, residents should have access to an appropriate platform for resolving disputes related to maintenance, common facilities and association decisions under the Uttar Pradesh Apartment Act, 2010.
The Lucknow bench of the Allahabad High Court has asked the Uttar Pradesh government to consider establishing a dedicated grievance forum for addressing disputes between apartment owners and Residents’ Welfare Associations (RWAs). The direction was issued in July 2026 during the hearing of a petition filed by residents of Sarvodaya Sulabh Apartments in Gomti Nagar Extension, Lucknow, where the court examined issues related to the functioning of apartment associations and the rights of individual residents.
The petition was heard by a division bench of the High Court, which considered the concerns raised by apartment owners regarding decisions taken within their residential society. During the proceedings, the court examined the scope of judicial intervention in matters concerning elected apartment associations and the mechanisms available to residents for resolving internal disputes.
The court observed that RWAs and apartment owners’ associations are responsible for managing various aspects of residential communities, including maintenance of common areas and administration of shared facilities. Since these bodies are generally formed through a collective process involving residents, decisions taken by them require consideration within the framework governing apartment societies.
However, the bench also highlighted the absence of a specialised and accessible mechanism for addressing disputes that may arise between individual apartment owners and management associations. The court suggested that the state government evaluate whether a suitable authority or forum could be created to deal with such grievances.
The matter relates to the implementation of the Uttar Pradesh Apartment (Promotion of Construction, Ownership and Maintenance) Act, 2010, which provides provisions relating to apartment ownership, maintenance obligations and the functioning of apartment owners’ associations. The court indicated that the state could examine whether the existing legal framework requires additional institutional support to address disputes effectively.
The court’s observation is significant in the context of increasing apartment development across Uttar Pradesh. Cities including Lucknow, Noida, Greater Noida and Ghaziabad have witnessed substantial growth in group housing projects, resulting in a larger number of residents living under association-based management systems.
Disputes within apartment complexes often involve matters such as maintenance responsibilities, use of common facilities, society administration and implementation of association decisions. The absence of a dedicated resolution mechanism can result in prolonged disagreements between residents and management bodies.
While the court did not direct the immediate creation of a new authority, it has placed the matter before the state government for consideration. The government will examine whether a formal grievance mechanism can be introduced within the existing regulatory structure to provide a platform for apartment owners and RWAs to resolve disputes.
The development could lead to further discussions on strengthening governance systems for residential societies in Uttar Pradesh and improving dispute resolution processes for apartment communities.
