The Karnataka government has unveiled a draft Apartment Ownership Bill that seeks to modernise the legal framework governing apartment ownership and management across the state. The proposed legislation is expected to replace the existing law with a more comprehensive framework that reflects the growing prominence of apartment living in Karnataka's urban centres, particularly Bengaluru. 
Deputy Chief Minister D.K. Shivakumar announced that the government has invited suggestions from apartment owners, resident welfare associations, developers and other stakeholders before the Bill is finalised and tabled in the State Legislature. The consultation process is intended to ensure that the legislation addresses practical concerns faced by residents while creating a balanced regulatory framework. 
One of the primary objectives of the proposed Bill is to provide greater clarity on the ownership, management and maintenance of apartment complexes. The draft seeks to define the rights and responsibilities of apartment owners, developers and management bodies more clearly, reducing ambiguities that have often resulted in disputes over common areas, maintenance charges and governance. 
The legislation also proposes stronger safeguards for flat owners by introducing greater transparency in the formation and functioning of apartment associations. Resident bodies are expected to have clearly defined powers and responsibilities, while developers may be required to complete the transfer of common areas and management responsibilities within prescribed timelines after project completion. 
Another important aspect of the proposed framework is the emphasis on accountability. The draft includes provisions intended to improve financial transparency, record-keeping and decision-making within apartment associations. These measures aim to ensure that maintenance funds, common assets and shared facilities are managed in a fair and transparent manner for the benefit of all residents. 
The government believes the new legislation is necessary because apartment ownership has expanded significantly over the past two decades, particularly in Bengaluru, where multi-storey residential developments have become the dominant form of urban housing. Existing laws, drafted decades ago, are considered inadequate to address the complexities of modern apartment communities and mixed-use developments. 
The draft Bill is also expected to establish mechanisms for resolving disputes between apartment owners, associations and developers more efficiently. By providing a clearer legal framework, the government aims to minimise prolonged litigation while encouraging better compliance with statutory obligations by all stakeholders. 
Real estate industry experts have welcomed the government's decision to seek public consultation before introducing the legislation. They note that incorporating feedback from homeowners, developers and legal experts could help create a balanced law that protects consumer interests while ensuring smooth management of residential communities. 
Once enacted, the proposed Apartment Ownership Bill is expected to become one of Karnataka's most significant housing reforms, providing a modern legal framework for apartment governance and strengthening the rights of millions of flat owners across the state.
