Delhi court cancels bail of Nivas Promoters director in Greater Noida homebuyer fraud case

Synopsis

A Delhi court has cancelled the bail granted to Rahul Chamola, director of Nivas Promoters Pvt Ltd, in a case involving the alleged cheating of homebuyers in a Greater Noida housing project. The court found that Chamola repeatedly violated bail conditions, ignored judicial directions and failed to cooperate fully with the investigation. The prosecution had sought cancellation of his bail, granted in December 2023, citing persistent non-compliance, including failure to appear before the court, non-payment of costs imposed by the judiciary and repeated breaches of investigation requirements. The court held that his conduct constituted sufficient legal grounds to revoke the concession of bail.

A Delhi court has revoked the bail granted to Rahul Chamola, director of Nivas Promoters Pvt Ltd, in connection with an alleged homebuyer fraud case linked to a residential project in Greater Noida. The order was passed during the past week after the prosecution argued that the accused had repeatedly breached the conditions under which bail had been granted in December 2023. 
Judicial Magistrate Ankit Garg was hearing an application filed by the prosecution seeking cancellation of Chamola's regular bail. The court observed that the accused had consistently failed to comply with judicial directions and had misused the concession granted by the court. It held that the repeated violations demonstrated a deliberate disregard for the conditions attached to his release. 
According to the court record, Chamola was directed in February 2024 to appear physically before the court on every hearing. Although he was granted exemption from personal appearance on one occasion after being ordered to pay costs of INR 5,000, the court noted that the amount remained unpaid several months later. In April 2025, his absence compelled the court to issue bailable warrants to secure his appearance. 
The court further noted that the present application for cancellation of bail became necessary because of continued non-compliance. In May this year, the investigating officer informed the court that despite repeated attempts, the accused could not be traced. Although Chamola subsequently joined the investigation in June, the court said he left the proceedings midway. In the following month, despite being directed to appear physically, he participated only through video conferencing. 
While cancelling the bail, the magistrate observed that the accused had repeatedly ignored express bail conditions, failed to honour court directions despite being granted several opportunities and compelled the judiciary to issue warrants to secure his presence. The order stated that persistent and wilful violations of bail conditions and repeated misuse of the concession constituted recognised legal grounds for revoking bail. The court added that the cumulative conduct of the accused left no reason to believe that further indulgence would ensure compliance. 
The case relates to allegations that Chamola induced homebuyers to invest in a Greater Noida housing project but failed to deliver the promised flats. According to the complaint, he allegedly conspired with another accused, Shelendra Sharma, to relaunch the project under the name "Renowned" through companies controlled by Sharma in an attempt to continue attracting buyers. Sharma has also been named as a co-accused in another FIR involving Chamola.
