The Navi Mumbai Municipal Corporation (NMMC) has issued a public advisory outlining the action being taken against unauthorised constructions following directions from the Bombay High Court in ongoing public interest litigation. The civic body said surveys conducted across its jurisdiction identified 12,687 unauthorised constructions, of which 4,946 were found to have no municipal building permission. Pursuant to court orders, notices have been issued to all identified property owners, hearings are underway and demolition action has commenced ward-wise. NMMC has also urged prospective homebuyers to verify construction approvals and Occupation Certificates before purchasing properties and warned that illegal constructions will face demolition and legal action under the Maharashtra Regional and Town Planning (MRTP) Act.
The Navi Mumbai Municipal Corporation (NMMC) has appealed to citizens not to undertake or purchase unauthorised constructions, following directions issued by the Bombay High Court in ongoing public interest litigation concerning illegal developments across the municipal area. The civic body said it has initiated surveys, hearings and enforcement measures in compliance with judicial orders and has urged property owners to regularise eligible constructions wherever permissible under applicable regulations.
According to NMMC, the proceedings arise from Public Interest Litigation (PIL) No. 80 of 2013 and Contempt Petition No. 562 of 2022, filed by Rajiv Mohan Mishra, along with PIL No. 111 of 2022 and Contempt Petition No. 685 of 2026 filed by Kishor Sundar Shetty. The latter petition concerns alleged Floor Space Index (FSI) violations and unauthorised constructions in Low Income Group (LIG) and Middle Income Group (MIG) housing in Airoli, Ghansoli, Koparkhairane and Turbhe. NMMC and the Maharashtra Urban Development Department have been named as respondents in the proceedings.
The civic body stated that the matter was first heard by the Bombay High Court in September 2022. Subsequently, in an order passed on 27 March 2025, the court directed NMMC to undertake a comprehensive survey across its jurisdiction to identify illegal and irregular constructions within four months. The court also instructed the corporation to issue notices to owners and occupants of identified structures and provide them with an opportunity to be heard before taking demolition action.
NMMC said the survey identified 12,687 unauthorised constructions, including 4,946 structures where no municipal building permission was found. In compliance with the court's directions, hearing notices have been issued to all identified property owners. The corporation informed that, under an affidavit submitted before the High Court on 15 June 2026, every ward office has been directed to conduct at least 50 hearings per day on three days each week, amounting to a minimum of 150 hearings per week. Property owners whose buildings are eligible for regularisation have been asked to submit applications and supporting documents to the Town Planning Department for consideration.
The civic body further stated that the High Court heard the matter on 7 July, 14 July and 21 July this year and directed NMMC to continue removing unauthorised constructions while periodically submitting compliance reports. Accordingly, demolition drives are currently being undertaken across different municipal wards.
Issuing a public advisory, NMMC warned that carrying out unauthorised construction is an offence under the law and that such structures are liable to demolition under the Maharashtra Regional and Town Planning (MRTP) Act. The corporation added that demolition costs will be recovered from the concerned property owner or landowner.
The civic body also advised prospective homebuyers to verify municipal construction permissions, Commencement Certificates (CC) and Occupation Certificates (OC) before purchasing a property. Citizens have been encouraged to verify approvals through the official NMMC website and report any ongoing unauthorised construction to the respective ward offices.
NMMC clarified that unauthorised buildings are not provided with authorised municipal water supply or sewerage connections. It also noted that, as Navi Mumbai comprises CIDCO-owned land, LIG/MIG housing and gaothan areas, enforcement action against illegal buildings is undertaken by both NMMC and CIDCO. The corporation urged developers, landowners and citizens not to undertake any new unauthorised construction, stating that violations would attract legal action under Sections 33(1)(a), 53(1)(b) and 54 of the MRTP Act, in addition to demolition and recovery of associated costs.
