Orris Infrastructure directors booked in Gurugram land collaboration dispute

Synopsis

Gurugram Police have registered a case against Orris Infrastructure Pvt Ltd, its directors Vijay Gupta and Amit Gupta, and authorised signatory Jitender Singh over allegations of cheating and criminal conspiracy linked to a land collaboration agreement in Badha village near Manesar. The complainants, who are legal heirs of the original landowners, alleged that plots promised under a development agreement were subsequently transferred to third parties despite earlier allotment letters issued in their favour. The FIR was registered on 7 July under Sections 420 and 120-B of the Indian Penal Code (IPC). Police said the matter is under investigation and legal action will be taken based on the findings.

Gurugram Police have registered a case of cheating and criminal conspiracy against Orris Infrastructure Pvt Ltd, its directors Vijay Gupta and Amit Gupta, and authorised signatory Jitender Singh over allegations of fraud related to a land collaboration agreement involving agricultural land in Badha village near Manesar. The FIR was lodged at Kherki Daula Police Station on 7 July under Sections 420 (cheating) and 120-B (criminal conspiracy) of the Indian Penal Code following a complaint by the legal heirs of the original landowners. 
The complainants—Ashwani Kumar, Rajpal and Krishan Kumar, legal heirs of the late Anand Prakash—alleged that the developer transferred residential plots allotted to them under the collaboration agreement to third parties despite issuing allotment letters in their favour. The police have initiated an investigation into the allegations. 
According to the complaint, the three families jointly owned around three acres of agricultural land in Badha village. In April 2010, they entered into a registered collaboration agreement with Orris Infrastructure for the development of the land. Under the agreement, the developer was to allot 1,200 square yards of developed residential plots to each landowner in exchange for the land contributed to the project. 
The complainants further alleged that a memorandum executed in 2012 revised the agreement by making the developer responsible for paying external and internal development charges. They claimed they later discovered that several plots originally allotted to them had been transferred to other buyers without their knowledge or consent. The issue reportedly came to light after they found construction activity taking place on plots they believed had been allocated under the original agreement. 
Based on the complaint, Gurugram Police registered the FIR and have begun examining the documents and transactions associated with the collaboration agreement. Investigating officers said the allegations will be verified and further legal action will be taken in accordance with the outcome of the investigation. 
The latest case adds to the legal scrutiny surrounding Orris Infrastructure, which has previously faced investigations in connection with other real estate matters. However, the present FIR specifically relates to the alleged transfer of plots promised under the Badha village collaboration agreement, and the allegations remain under investigation. No findings on the merits of the case have yet been reached by the authorities.
