Mumbai developer booked over alleged INR 1.8 crore investment fraud

Synopsis

A Mumbai-based developer and an associate have been booked for allegedly defrauding two investors of a combined INR 1.8 crore by promising commercial units in a redevelopment project at New Kamalkunj Co-operative Housing Society in Bandra (West). According to the police, the investors paid INR 1.3 crore and INR 50 lakh, respectively, after receiving assurances and allotment-related documents but were not handed possession of the promised shops. When they later sought refunds, the money was allegedly not returned, prompting a complaint. An FIR has been registered under the Indian Penal Code as the alleged offences predate the implementation of the Bharatiya Nyaya Sanhita, and the investigation is in progress.

A Mumbai developer and another individual have been booked for allegedly cheating two investors of a combined INR 1.8 crore by promising to allot commercial units in a redevelopment project in Bandra (West), according to the police. The FIR was registered on Wednesday following a complaint filed by Sandip Singh Chandok, a 55-year-old automobile businessman. Police said the case has been registered under the Indian Penal Code because the alleged offences were committed before the Bharatiya Nyaya Sanhita came into effect. 
The accused have been identified as Saurabh Bhuta, a director of Meeti Developer, and Harsha Bhuta. The case has been registered at Khar police station following a preliminary inquiry into the allegations made by the complainants. 
According to the police, Chandok was introduced to Saurabh Bhuta through a real estate agent in 2018 in connection with the redevelopment of New Kamalkunj Co-operative Housing Society in Bandra (West). During their interactions, Saurabh allegedly assured Chandok that shop number 35, measuring 522 sq ft, would be allotted to him as part of the redevelopment project. 
Police said Saurabh subsequently completed the required documentation and issued Chandok an allotment letter along with a booking letter. Relying on these assurances and documents, Chandok transferred approximately INR 1.3 crore to bank accounts specified by the accused over the period between 2018 and 2022. 
The investigation further revealed that another investor, Manoj Kumar Anand, was allegedly offered shop number 32 in the same redevelopment project. Police said Anand paid INR 50 lakh after receiving similar assurances regarding the allotment of the commercial unit. 
Despite accepting the funds, the accused allegedly failed to hand over possession of the promised shops to either investor. When Chandok and Anand later sought refunds of their investments, the money was allegedly not returned, leading them to approach the police. 
Based on the complaint and findings of the preliminary inquiry, Khar police registered an FIR against Saurabh Bhuta and Harsha Bhuta on charges including cheating under the Indian Penal Code. Police stated that the provisions of the IPC were invoked because the alleged offences occurred before the implementation of the Bharatiya Nyaya Sanhita. 
The investigation into the alleged fraud is continuing, and police are examining the financial transactions, documentation and other records linked to the redevelopment project as part of the probe.
