The National Green Tribunal (NGT) has issued notices to the Commission for Air Quality Management (CAQM), the Haryana State Pollution Control Board and Uttar Haryana Bijli Vitran Nigam Ltd. after a Haryana-based construction company challenged a closure notice issued against it. The appeal, filed by Ramakrishna Buildwell Pvt Ltd, concerns a CAQM order issued earlier this year. The company had previously approached the Punjab and Haryana High Court, which granted temporary protection against electricity disconnection before the petition was withdrawn. With the interim relief having expired and the power connection subsequently disconnected, the NGT has directed the respondents to submit their replies within two weeks and listed the matter for further hearing on August 11.
The National Green Tribunal (NGT) has sought responses from the Commission for Air Quality Management (CAQM) in the National Capital Region and adjoining areas, along with other authorities, on an appeal filed by Haryana-based Ramakrishna Buildwell Pvt Ltd challenging a closure notice issued against the company. The tribunal issued the direction in the past week while hearing the matter relating to a closure order served by the air quality regulator.
The appeal challenges a closure notice issued by the CAQM on April 30 this year. The matter came before a bench comprising NGT Chairperson Justice Prakash Shrivastava and expert member Afroz Ahmad, who recorded the submissions made on behalf of the company during the proceedings.
According to the tribunal's order dated July 6, the company's counsel informed the bench that the closure notice had earlier been challenged before the Punjab and Haryana High Court. That petition, however, was withdrawn on June 3 after the High Court had granted interim protection against the disconnection of the company's electricity supply.
The NGT noted that the High Court's interim relief had prevented the electricity connection from being disconnected for a period of 15 days. The company further submitted that the temporary protection had since lapsed and that its electricity supply had subsequently been disconnected.
After considering the submissions, the tribunal directed that notices be issued to the respondents in the case. The respondents include the Commission for Air Quality Management (CAQM), the Haryana State Pollution Control Board and Uttar Haryana Bijli Vitran Nigam Ltd.
The tribunal instructed the respondent authorities to file their replies within two weeks. It also scheduled the matter for further hearing on August 11, when the case will be taken up after the responses have been submitted.
The proceedings relate solely to the company's challenge against the CAQM's closure notice, with the NGT currently examining the matter after the earlier High Court proceedings concluded following the withdrawal of the petition. The tribunal has not expressed any view on the merits of the case at this stage and has sought the respondents' submissions before proceeding further.
