A consumer commission has issued non-bailable warrants (NBWs) against the Managing Director and a director of Deluris Buildtech India Pvt. Ltd. in connection with the alleged non-compliance of compensation orders passed in favour of homebuyers of the company's Zara Rossa residential project in Gurugram. The warrants were issued during execution proceedings initiated after the developer allegedly failed to comply with earlier directions of the commission.
According to information reported across multiple sources, the proceedings relate to complaints filed by homebuyers who alleged delays in receiving possession of their apartments. The consumer commission had previously directed the developer to compensate the buyers by paying interest on the amounts deposited from the respective dates of payment until possession was handed over. When the compensation orders were allegedly not implemented despite notice, the complainants sought enforcement through execution proceedings.
The commission subsequently directed that non-bailable warrants be issued against Managing Director Vipul Sachdeva and director Ajay Bharti through the Deputy Commissioner of Police (South District), Delhi. The warrants require the officials to be produced before the commission on the next date of hearing as part of the enforcement process under the Consumer Protection Act.
The Zara Rossa project, located in Sector 112, Gurugram, has been at the centre of several consumer complaints related to delayed possession and compensation. The latest development reflects the consumer forum's use of enforcement mechanisms to ensure compliance with its orders in real estate disputes, particularly where compensation awarded to homebuyers remains unpaid.
Responding to the proceedings, Deluris Buildtech stated that possession of apartments in the Zara Rossa project was handed over after the occupancy certificate was received in May 2024. The company further said that it considers the compensation awarded in the concerned cases to be disproportionate and has challenged the orders through review petitions and appeals, which are currently pending before the appropriate judicial forums. It also reiterated that it respects the judicial process and will continue to pursue legal remedies in accordance with the law.
