A long-running dispute over land reserved for burial grounds in Thane has once again come under judicial scrutiny, with the Bombay High Court examining allegations of encroachment, non-compliance with earlier court directives and the continued use of reserved land for purposes other than those originally designated under planning regulations.
The latest proceedings stem from concerns raised by members of the Christian community and other petitioners regarding plots that have been reserved as burial grounds in Thane's development plans. According to the petitioners, portions of the land remain affected by encroachments and competing land-use claims despite previous court interventions intended to safeguard the reservation status of the properties.
The matter has gained further significance following the filing of a contempt petition before the High Court. The plea alleges that civic authorities failed to adequately implement earlier judicial directions concerning the protection and preservation of the burial ground land. Petitioners have argued that the delay in enforcing the court's orders has contributed to continued uncertainty over the future of the reserved plots.
The dispute traces its origins to questions surrounding the use and status of land designated for cemetery and burial ground purposes under approved development plans. Over the years, concerns have repeatedly been raised regarding attempts to utilise or reclassify portions of such land for alternative purposes. Previous observations made by the Bombay High Court emphasised that plots specifically reserved for burial grounds could not be diverted for unrelated uses without following due legal and planning procedures.
During earlier hearings, the court had underlined the importance of preserving reservations created under statutory planning frameworks, particularly when they relate to essential community infrastructure. Such reservations are intended to serve long-term public needs and cannot be casually altered or ignored through administrative actions.
The current proceedings have brought the spotlight back on the role of the Thane Municipal Corporation and other concerned authorities in ensuring compliance with development plan reservations. Allegations presented before the court suggest that questions remain regarding enforcement, monitoring and the handling of land-use disputes involving the affected plots.
For local residents and members of the Christian community, the issue extends beyond a property dispute and concerns access to adequate burial facilities within the city. Petitioners have argued that continued uncertainty over reserved cemetery land affects the availability of essential civic infrastructure and undermines the purpose for which the reservations were originally created.
