Odisha: State government plans amendments to ease sale deed registration process

The Odisha government is considering amendments to various real estate laws, including the Odisha Real Estate (Regulation and Development) Act of 2016 and the Odisha Apartment (Ownership and Management) Act of 2023, to make the process of registering sale deeds for plots and apartments more efficient.


Earlier this week, Revenue and Disaster Management Minister Suresh Pujari highlighted the challenges in the registration process, stating that the government is currently reviewing the necessary changes to improve the situation. He noted that both citizens and the government have been affected, as individuals are facing difficulties in registering sale deeds, while the government is losing significant revenue from stamp duty and registration fees.

Pujari added that the government has been consulting with relevant stakeholders on the issue, and amendments to the existing rules and regulations will soon be implemented to streamline the registration process. He reassured that the legal changes will be incorporated promptly.

The registration of sale deeds for apartments and land faced significant delays in 2022 after the Orissa High Court intervened and instructed the Inspector General of Revenue to ensure that all procedures were strictly followed at the sub-registrar level. While the sale deed registration process for apartments resumed in May following the enactment of the Odisha Apartment (Ownership and Management) Act of 2023, the number of completed registrations remains low due to requirements such as an occupancy certificate and an association of allottees' certificate.

Real estate expert Bimalendu Pradhan pointed out that many apartments in the city lack the necessary occupancy certificates, which has led to delays in registration. He added that some sub-registrars had violated rules by processing registrations without the required documents, leading to their dismissal. Pradhan urged the government to introduce a regularisation scheme for existing buildings as part of the amendments, suggesting that this could eliminate the registration bottlenecks.
