The Haryana Real Estate Regulatory Authority (H-RERA) has ruled that Elan Buildcon must pay fixed returns to allottees and complete the conveyance deed in a dispute over commercial units in The Palm Springs Plaza, a Gurugram development. Allottees had alleged delays and contractual non-performance after making payments for units in the project. The adjudicating officer held that Elan Buildcon had failed to honour its contractual obligations on possession and conveyance, breaching terms of allotment. The authority directed the promoter to compensate buyers with fixed returns at 10.85 per cent per annum on amounts paid from due dates to payment, and to execute conveyance within 60 days of the order. H-RERA also imposed costs and rejected the promoter's counter-claims. The Bombay High Court has partly upheld an arbitral award in favour of Mumbai Metro One Pvt Ltd (MMOPL) in its dispute with the Mumbai Metropolitan Region Development Authority (MMRDA) over cost escalation in Metro Line 1. While the court accepted that project delays led to higher costs, it significantly reduced the compensation earlier granted by the tribunal. The Maharashtra government has directed the Brihanmumbai Municipal Corporation (BMC) to develop and implement an Artificial Intelligence (AI) and Internet of Things (IoT)-based system to monitor air pollution sources across Mumbai. The instruction was issued by Chief Minister Devendra Fadnavis during the state legislative council session following concerns over rising pollution levels in areas such as Kherwadi in Bandra. The Navi Mumbai Municipal Corporation has carried out a demolition drive against unauthorised construction in the Nerul division, intensifying enforcement under the Maharashtra Regional and Town Planning Act, 1966. The action was undertaken on 23 February 2026 after the concerned property owner failed to comply with a notice issued under Section 54 of the Act within the stipulated period. The structure, located in Sector 6, Sarsole village, Nerul, was found to be under illegal construction despite prior intimation from the civic authorities. The demolition was executed by the encroachment department with mechanical support and police protection, under the supervision of senior municipal officials. The policy shift, which follows the recent merger of the erstwhile Housing Board into HSVP, aims to diversify urban growth beyond private-sector-driven projects and respond to rising housing demand and infrastructure pressure in key National Capital Region (NCR) markets. Phase-wise land procurement will involve consent-based acquisition and direct purchases of landowners parcels through online platforms such as the e-Bhoomi portal, with an estimated 1.67 lakh acres statewide earmarked for development and around 23,000+ acres in Gurugram alone. The expansion targets multiple growth corridors including the Southern Peripheral Road, Dwarka Expressway and New Gurgaon belt and is designed to support organised real estate supply, plotted housing and planned neighbourhoods. The National Company Law Appellate Tribunal (NCLAT) has mandated that the day-to-day maintenance responsibilities of two major **Supertech housing societies in Noida Ecociti in Sector 137 and 34 Pavilion in Sector 34 be transferred to their respective registered apartment owners associations (AOAs) within 30 days, a senior bench ordered this week. The directive, delivered by a panel led by Chairperson Justice Ashok Bhushan and member (technical) Barun Mitra, applies during the ongoing insolvency proceedings involving Supertech Ltd, underlining that maintenance should vest with AOAs once the majority of residents have taken possession. The ruling requires the current maintenance agency YG Estates Facilities Management Pvt Ltd to complete the handover under supervision of the interim resolution professional, and affirms that claims of pending dues will not delay the transfer. The Karnataka Real Estate Regulatory Authority (K-RERA) has intensified enforcement actions against unregistered residential real estate projects in the state, issuing repeated notices and opening inquiries amid a surge in complaints from homebuyers. Since 2021, the authority has received 765 complaints related to projects that should have been registered under the Real Estate (Regulation and Development) Act, 2016 but were not, resolving 440 cases and progressing 325 others through hearings. A key challenge identified by the regulator is the existence of structural and procedural loopholes that allow promoters to bypass mandatory RERA registration, including planning authorities granting sanctions and occupancy certificates without requiring a RERA number, and property registrations proceeding without RERA verification. Authorities and homebuyer groups have said these gaps undermine regulatory protections and pose heightened risks of fraud for buyers. K-RERA has called for stronger enforcement and greater awareness to close loopholes in the system.Read more
