UP-RERA launches online system to tackle excessive property transfer charges

The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has introduced an online complaint mechanism for homebuyers and allottees facing excessive transfer charges imposed by developers during property transfers. The complaints can now be filed digitally through Form-M under the e-court section on the UP-RERA portal.


The online facility has been introduced after the implementation of the 10th amendment to the UP-RERA General Regulations, 2019. Under the amended Regulation 47(c), promoters are not permitted to execute a fresh agreement for sale or lease during transfer or assignment of a property. Instead, the transfer must be recorded through an endorsement in the existing agreement while updating the promoter’s records accordingly.

The amendment also brings clarity on succession-related transfers. In cases where the original allottee has passed away and the transfer is being made to a legal heir within the family, the promoter can charge a processing fee of only up to INR 1,000. The successor will have to submit documents including the death certificate, succession certificate issued by the competent authority and no-objection certificates from the remaining legal heirs.

For transfers made to another family member, the processing fee has similarly been capped at INR 1,000. In transfers involving non-family members, developers are allowed to charge a maximum processing fee of INR 25,000. Any amount charged beyond these limits can now be challenged through the online complaint system.

UP-RERA introduced the mechanism after receiving multiple complaints regarding arbitrary transfer charges by developers in several housing projects. In some cases, builders were reportedly charging between INR 200 and INR 1,000 per sq ft for property transfers, leading to overall charges reaching nearly INR 25 lakh to INR 30 lakh.

The authority has integrated the complaint filing process into its digital e-court platform to make the process easier for homebuyers. Applicants are required to log into the portal, select the e-court option, fill Form-M and upload supporting documents while filing the complaint. A complaint fee of INR 1,000 has also been prescribed.

The latest move is expected to improve transparency in property transfer procedures and reduce disputes between developers and buyers. The changes may also provide relief to families and legal heirs who previously faced delays and high financial demands during succession-based transfers in residential projects across Uttar Pradesh.
