Uttar Pradesh Real Estate Regulatory Authority has capped the processing fee for transfer of flats to legal heirs at INR 1,000 in cases involving the death of the original allottee, introducing revised provisions aimed at preventing arbitrary charges by developers. The amendment to Regulation 47 was announced by UP RERA Chairman Sanjay Bhoosreddy during the authority’s 10-year completion review earlier this week. The regulator stated that several complaints had been received against builders allegedly charging transfer fees running into lakhs of rupees. The revised framework also fixes a maximum charge of INR 25,000 for transfers outside blood relations and standardises documentation requirements. UP RERA additionally highlighted strong growth in project registrations and investment inflows across Uttar Pradesh’s real estate sector.
Uttar Pradesh Real Estate Regulatory Authority has revised its regulations to cap the fee charged for transfer of flats to legal heirs at INR 1,000 following complaints of excessive charges being imposed by developers and promoters in succession-related property transfers.
The revised provisions were announced earlier this week by Sanjay Bhoosreddy while addressing reporters during events marking 10 years of UP RERA. Under the amended framework, developers will now be required to transfer flats by default to the spouse, son or daughter of a deceased allottee on payment of a nominal processing charge capped at INR 1,000.
According to the authority, the move follows multiple complaints from homebuyers and their families alleging that several builders had been levying arbitrary transfer charges, in some cases calculated on a per square foot basis. Bhoosreddy stated that certain developers were charging between INR 200 and INR 1,000 per sq ft, resulting in transfer demands ranging between INR 25 lakh and INR 30 lakh despite the original allottee having already paid the full value of the property.
Following these complaints, UP RERA revised Regulation 47 relating to administrative and standard fees to regulate charges imposed by promoters in succession and allotment transfer cases.
Under the updated rules, legal heirs seeking transfer of a flat within blood relations will need to submit supporting documents including the death certificate of the allottee, succession certificate issued by the competent authority and no-objection certificates from other legal heirs.
For transfers involving individuals outside the immediate family, promoters will be permitted to charge a maximum fee of INR 25,000. The regulator further clarified that such transfers would not require execution of a fresh sale deed or lease agreement.
Officials stated that the revised provisions were intended to curb unfair practices by developers and establish a transparent and uniform process for transfer of property rights after the death of an allottee.
During the briefing, the regulator also presented data highlighting continued expansion in Uttar Pradesh’s real estate sector. According to UP RERA figures, 197 new projects were registered in 2023, rising to 259 projects in 2024 and 308 projects in 2025. In the first four months of 2026, the authority has already registered 106 projects, compared to 84 projects during the corresponding period last year.
Investment levels in projects registered with UP RERA also recorded steady growth. The authority stated that investments worth INR 28,411 crore were recorded in 2023, increasing to INR 44,526 crore in 2024 and INR 68,328 crore in 2025. During the first four months of 2026, investment inflows worth INR 25,156 crore have already been registered.
Officials attributed the growth to increased investor confidence supported by policy interventions, simplified approval procedures and greater transparency in the regulatory framework.
The authority further noted that real estate activity was increasingly spreading beyond the National Capital Region. Lucknow emerged as one of the leading markets in the state during 2025, recording 67 project registrations compared to 69 projects in Gautam Buddh Nagar.
UP RERA also highlighted the performance of its digital grievance resolution platform ‘RERA Samvaad’, launched during the COVID-19 pandemic. According to officials, the platform has conducted more than 198 sessions so far and facilitated resolution of over 5,200 cases across the state.
