The Allahabad High Court stated in the past week that it has upheld the land acquisition undertaken for the expansion of the Noida International Airport in Gautam Buddha Nagar district, dismissing a batch of petitions filed by landowners challenging the process and its legality.


The court observed that the acquisition had been carried out in accordance with the provisions of the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, and found no material irregularities in the procedure followed by the authorities.

The acquisition pertains to the next stages of the airport’s development, covering multiple phases aimed at expanding the aviation hub in the region. The land being acquired spans several villages in Gautam Buddha Nagar and is intended for the creation of additional infrastructure, including runways, cargo terminals, maintenance facilities and supporting transport connectivity.

The High Court, while validating the acquisition, emphasised the importance of rehabilitation and resettlement measures for affected families. It directed that due process must be followed to ensure that displaced residents are provided with appropriate compensation and relocation support in a timely manner.

The petitions before the court had challenged notifications issued under the 2013 Act, including preliminary and final declarations related to land acquisition. The bench, after examining the submissions, concluded that the acquisition served a defined public purpose linked to the development of critical infrastructure and did not warrant judicial interference.

The Noida International Airport project, also referred to as Jewar Airport, is being developed as a multi-phase aviation hub with significant land requirements to accommodate future expansion. Government planning documents indicate that the project is envisaged with long-term capacity additions and integrated infrastructure to support regional connectivity and economic activity.

The court’s decision removes a key legal hurdle for the expansion phases of the airport project, allowing authorities to proceed with land acquisition and subsequent development activities. At the same time, the emphasis on rehabilitation underscores the statutory obligation to address the impact on local communities affected by large-scale infrastructure projects.
