ED orders provisional attachment of over five lakh sqm of prime Goa land worth INR 1,268.6 crore

The Enforcement Directorate (ED) has provisionally attached 19 immovable properties spread across Anjuna, Assagao and Ucassaim in North Goa, covering more than five lakh square metres and valued at about INR 1,268.6 crore. The action, undertaken earlier this week under the Prevention of Money Laundering Act (PMLA), follows ongoing investigations into an alleged land-grab network. Officials stated that forged allotment certificates, fabricated demarcation orders and falsified historical sale and gift deeds were used to mutate community and privately held land before transferring it through frontmen. Earlier actions by the ED had included freezing bank accounts and other assets worth INR 12.8 crore.Read more

Tribunal clarifies CoC's sole authority to pick liquidator under IBC framework

The NCLAT has ruled that only a Committee of Creditors (CoC) can choose the liquidator in cases where the resolution professional (RP) does not consent to continue in that role. The tribunal set aside two NCLT orders that had directly appointed liquidators, stating that such appointments exceeded the NCLT's authority. Under the Insolvency and Bankruptcy Code, an RP becomes liquidator only with written consent; if not, the NCLT may replace the RP, but the CoC must propose the new liquidator. The ruling also overturns a 2023 regulatory circular restricting RPs from becoming liquidators, reaffirming that statutory provisions prevail and that creditors must have the final say.Read more

Punjab RERA directs developer to hand over long-delayed SCO unit after decade-long wait

Punjab RERA has ordered a Mohali-based developer to hand over possession of a long-delayed SCO unit in Sunny Enclave after the buyers waited nearly a decade despite having paid the entire consideration and completing all formalities. The allottees, who booked the unit in the early 2010s and even registered the conveyance deed years ago, had been denied possession because the project remained unfinished and mandatory occupation-related approvals were never issued. The Supreme Court rejected requests to extend the deadline for uploading Waqf property data on the UMEED portal under the 2025 amendments. Petitioners highlighted that only 1.6?lakh out of over ten lakh properties have been uploaded and cited technical and operational challenges. The Court noted that Waqf Tribunals are empowered to grant six-month extensions under Section?3B and advised petitioners to seek relief there.
