Gurugram District Magistrate Nishant Kumar Yadav has ordered the residents of Tower J in Chintels Paradiso, Sector 109, to vacate their flats within the space of 15 days, citing an IIT-Delhi audit report that deemed the building "unsafe." The order, issued under Section 163 of the Indian Civil Defence Code, follows a previous directive to vacate and demolish five other towers in the same society. The developer of the project, Chintels India Pvt. Ltd., is required to settle compensation claims for affected residents. Police assistance may be sought for enforcement, with penalties for non-compliance under the Disaster Management Act applicable.
Earlier this week, the Gurugram District Magistrate, Nishant Kumar Yadav, ordered the residents of Tower J in Chintels Paradiso society, located in Sector 109, to vacate their flats within 15 days. This decision follows a safety audit conducted by IIT-Delhi, which deemed the tower "unsafe for habitation." The audit report, released on January 5, led to the urgent evacuation order.
The evacuation order was issued under Section 163 of the Indian Civil Defence Code, in conjunction with Section 34 of the Disaster Management Act, as announced in an official statement from the district administration. This is the latest development in an ongoing situation where multiple towers in the society have been found unsafe. Earlier in April, Towers D, E, F, G, and H were also evacuated following a similar audit report and are set for demolition.
The order to vacate Tower J is seen as necessary to protect the lives and property of the residents. The district administration has made it clear that the police force can be involved to ensure compliance with the evacuation order.
In addition to the evacuation, there is an ongoing process regarding compensation for the affected residents. The responsibility for compensating the residents and flat owners lies with the developer, Chintels India Pvt. Ltd. The Special Investigation Team (SIT) set up to handle this case is overseeing the compensation process. The order stressed that the developer must settle all claims of the allottees of Tower J within a specified timeframe. Failure to comply with the orders could result in legal action under various sections of the Indian Justice Code and the Disaster Management Act.
The urgency of these actions comes in the wake of a tragic incident on February 10, 2022, when six floors of Tower D in Chintels Paradiso society partially collapsed, resulting in the deaths of two women. This incident has led to ongoing disputes between the builder and the residents, with safety concerns remaining at the center.
