The Madras High court has ordered for the demolition of a compound wall constructed by Olympia Infra Tech Pvt Limited for its residential project Opaline. The order was passed after the court found that the structure had encroached upon a public road in Navalur, Chennai.
The Court has directed authorities to restore the portions of a public pond the company had encroached upon, creating parking for its residential project Opaline. Additionally, it has directed revenue authorities and the local civic body to take physical possession of all the OSR lands, waterbodies and roads that were to be provided within the site of Opaline and make necessary changes in the revenue records.
The Madras High Court passed the order after a plea was filed by Mandava Holdings Private Limited. Senior Advocate P S Raman, who represented Mandava Holdings, submitted a petition claiming that his client owns land located between Buckingham Canal and the Opaline project site. Promoters of Opaline had encroached upon ORS land that was to be surrendered to the local public, thereby cutting off his access to Old Mahabalipuram Road (OMR).
On account of this information, Thiruporur Tahsildar had conducted an inspected in May 2018 and found that Olympia had indeed built on ORS land. However, even upon forwarding the report to the Directorate of Town and Country Planning, no action was taken.
In November 2022, a bench directed Chengalpattu RDO to inspect the property and file a report. The report submitted to the Court confirmed that the waterbody was being used as a car parking lot and a wall had been constructed on a public road. Taking the report on record, the Court passed the order, directing authorities to complete all necessary actions within twelve weeks.
