Initiated by a complaint from investor Moinuddin Bora, the EOW found that the developer began accepting payments in January 2008 but consistently missed delivery deadlines. In a recent turn of events, Mumbai's Economic Offences Wing (EOW) has lodged a case against a prominent developer and five others, including three family members, for allegedly defrauding 139 prospective homeowners of a staggering Rs 45 crore. The accused had reportedly collected these funds under the guise of constructing a luxury residential tower named 'Maredian Heights' situated in Jogeshwari (W). Contrary to their promises, the project remains incomplete, with suspicions arising that the funds were diverted for personal benefits.
The investigation was initiated after a complaint was lodged by Moinuddin Bora, an Andheri resident. Bora's father had invested in the said project, anticipating a home in the upscale Maredian Heights on SV Road, Jogeshwari (West). The complaint highlights that the developer began accepting payments from potential buyers as early as January 2008. Despite collecting a hefty sum of Rs 45 crore from Bora's father and 138 other investors, the builder consistently failed to meet the delivery deadlines.
The prolonged delays and unfulfilled promises led to growing unrest among the investors. Despite their persistent follow-ups, the developer continued to postpone the completion dates, buying more time under various pretexts. Feeling aggrieved and suspecting foul play, the homebuyers collectively approached the EOW to voice their concerns.
Acting on the complaint, the EOW initially registered an FIR at the Amboli police station last Thursday. The case was subsequently transferred to the EOW for a comprehensive investigation. The individuals named in the FIR include Imtiyaz Hasan Ali Maredia, Pyar Ali Maredia, Barkat Ali Momin, Nuruddin Makhnojia, Sanif Maredia, and Aakil Maredia.
Based on the evidence and the severity of the allegations, the police have charged the six accused under various sections of the Indian Penal Code, including 406, 409, 420, and 34. Additionally, they face charges under sections 3, 5, and 13 of the Maharashtra Ownership of Flats Act (MOFA).
