Kanpur administration reclaims illegally sold Nazul land in Civil Lines

Synopsis

The Kanpur district administration has reclaimed a prime Nazul property in Civil Lines after an investigation revealed it was sold illegally in 2012. Originally allotted to the Beri family in 1982, the land had neither lease renewal nor rent payment for years. Heirs of the original lessees misrepresented it as freehold in the sale deed to a private builder. The District Magistrate ordered government re-entry, directing the plot, valued at around INR 24.77 crore (approximately USD 3 million), to be re-registered under government ownership, with oversight assigned to the Nazul and tehsildar officials.

The Kanpur district administration has taken formal action to reclaim a valuable Nazul land parcel in Civil Lines, following a detailed investigation by local authorities. The plot, originally allotted in 1982 to KC Beri, Tarang Beri, Neeraj Beri, and Vikas Beri, had not seen lease renewal or payment of lease rent for several years. Despite this, the heirs of the original lessees executed a sale deed in 2012 transferring the property to SA Builders Private Limited, falsely representing it as freehold.


The irregularities were uncovered by a joint investigation involving the sub-divisional magistrate (Sadar), the assistant in-charge officer (Nazul), and the tehsildar (Sadar). The authorities found that no permission from the collector had been obtained for the transfer, making the sale a violation of the Nazul Manual. The District Magistrate emphasized that selling Nazul land without depositing lease rent, renewing the lease, or obtaining necessary approvals breached legal provisions and undermined government property rights.

Following the findings, the District Magistrate issued a government re-entry order for plot no. 14/59A, Civil Lines, directing it to be re-registered as unallocated government land. Responsibility for its maintenance and administration has been jointly assigned to the assistant in-charge officer (Nazul) and the tehsildar (Sadar). With a current circle rate of around INR?24.77 crore (approximately USD?3?million), the reclamation corrects record discrepancies and restores the land under government control.

The move highlights the administration?s focus on enforcing lease rules and protecting public assets, ensuring that valuable urban Nazul land is not misused or transferred without proper legal procedures. It also underscores the importance of compliance with statutory provisions in managing state-owned properties, especially in central city areas with high commercial potential.
