The Allahabad High Court has directed state authorities, including development bodies and local agencies in Uttar Pradesh, to ensure that residential complexes provide accessible infrastructure for persons with disabilities, issuing the order in the past week to strengthen compliance with statutory norms and address gaps in implementation.


The directive was issued while hearing a matter concerning inadequate accessibility provisions in residential developments. The court noted that despite clear legal requirements under the Rights of Persons with Disabilities Act, several housing projects lacked basic facilities such as ramps, lifts designed for accessibility, and barrier-free movement within premises. It stated that such omissions restrict the ability of persons with disabilities to access and use residential spaces independently.

The bench instructed relevant authorities to incorporate accessibility checks at multiple stages of project development. This includes scrutiny during the approval of building plans as well as monitoring during construction. Development authorities have been asked to ensure that sanctioned layouts comply with prescribed accessibility standards before granting permissions.

In addition, the court directed that existing residential complexes should also be reviewed for compliance, where feasible. It indicated that retrofitting measures may be required in cases where infrastructure does not meet accessibility norms. The order places an obligation on developers, housing societies, and regulatory bodies to take corrective action where deficiencies are identified.

The ruling also underscores the role of municipal bodies and planning agencies in enforcing compliance. Officials have been instructed to avoid granting approvals to projects that fail to incorporate mandatory accessibility features.
