The resident had purchased a first floor flat in The Misty Greens project in Socorro, Goa, in 2018 for INR 38 lakh from Universal Developers. Soon after moving in, parts of the false ceiling collapsed due to water seepage from the roof slab. Although the builder carried out repairs, the waterproofing work proved inadequate, and leaks continued. The problem worsened during monsoon seasons, causing damage to interiors and furniture, and the resident repeatedly requested permanent solutions without success.

In 2021, water began seeping through the slab more extensively, causing significant inconvenience and further damage to the flat. The resident then approached the consumer forum seeking redress. The developer argued that if the leakage was severe, the owner should not have continued to reside in the flat. The commission rejected this argument, emphasizing that maintaining habitable conditions is the developer's responsibility and that structural defects must be addressed in a timely manner.

The forum directed the developer to repair the leakage completely within three months and awarded INR 25,000 to the resident for the inconvenience and damages caused. The commission also highlighted that repeated failure to rectify construction defects reflects a deficiency in service on the part of the builder.
