The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has imposed penalties totalling more than INR 2.43 crore on two Lucknow-based real estate promoters for failing to upload mandatory quarterly progress reports (QPRs) on the regulator's online portal. The action relates to the Arpita Infinity and Ganpati Smart City projects, both of which did not update required project information despite repeated notices from the authority. Under the Real Estate (Regulation and Development) Act, 2016 and the state RERA rules, promoters must submit quarterly updates on project progress, approvals, bookings and construction status within a stipulated timeframe. UP-RERA said the penalties represent up to five per cent of the respective project costs and directed both promoters to deposit the fines and update pending disclosures within 15 days, reinforcing regulatory oversight and transparency in project reporting.
The Uttar Pradesh Real Estate Regulatory Authority (UP-RERA) has imposed penalties exceeding INR 2.43 crore on two real estate developers based in Lucknow for repeatedly failing to upload mandatory quarterly progress reports (QPRs) for their registered housing projects on the regulator's online portal. The enforcement action was taken in the past week following repeated notices issued by the authority seeking compliance with disclosure requirements under the Real Estate (Regulation and Development) Act, 2016.
The first case relates to the Arpita Infinity project promoted by Sushil Kumar Katiyar. The project was registered with UP-RERA with a commencement date of 10 July 2024 and a scheduled completion date of 31 January 2027. According to the authority, the promoter failed to upload the required progress updates on the portal despite receiving notices regarding the statutory obligation. After reviewing the matter, UP-RERA imposed a penalty of INR 16.25 lakh, equivalent to five per cent of the project's estimated cost of INR 3.25 crore.
In a separate case, Ganpati Infrastructure Development Company, the promoter of the Ganpati Smart City project in Lucknow, was also found to have violated the same compliance requirement. The project commenced on 30 September 2024 and has an expected completion date of 24 October 2026. The authority observed that the developer had not updated the quarterly progress reports on the portal despite multiple communications issued by the regulator. Following its review, UP-RERA imposed a penalty of approximately INR 2.27 crore, which represents five per cent of the project's estimated cost of INR 45.45 crore.
Under Section 11(1) of the Real Estate (Regulation and Development) Act, 2016, promoters are required to regularly update project-related information on the regulator's website at the end of every quarter. The disclosures must include details such as the number and type of units booked, the status of garages, approvals obtained or pending, and the overall progress of construction. In addition, Rule 14(1)(a) of the Uttar Pradesh RERA Rules requires promoters to upload these updates within seven days of the completion of each quarter. Failure to comply with these provisions constitutes a violation that may attract penalties under Section 61 of the Act, which allows regulators to levy fines of up to five per cent of the estimated project cost.
UP-RERA chairman Sanjay Bhoosreddy stated that timely updating of quarterly progress reports is a statutory obligation for promoters and an important mechanism to maintain transparency in the real estate sector. He indicated that developers who fail to comply with regulatory requirements or directions issued by the authority would face financial penalties and other enforcement measures.
The authority has directed both promoters to deposit the penalties through a bank draft in favour of UP-RERA, Lucknow, within 15 days. They have also been instructed to upload all pending quarterly progress reports on the portal within the same period to ensure compliance with the regulatory disclosure framework governing registered real estate projects in the state.
