Shivalik Homes buyers still await property registries after years of delay

At Shivalik Homes in Surajpur, Greater Noida, more than 350 buyers have been unable to complete property registries for over a decade, even after receiving possession of their flats. The developer, Cosmos Infraestate Pvt. Ltd., has not cleared lease rent dues of around INR 1.8 crore to UPSIDA, preventing issuance of completion and occupancy certificates. Authorities have issued multiple notices, sealed unsold flats, and halted sales. Despite assurances from the developer to clear dues and submit documents by March, buyers continue to face financial and legal hurdles, with limited confidence in resolution.

More than 350 homebuyers at Shivalik Homes in Surajpur, Greater Noida, are still waiting for property registries despite living in their flats for years. The project, developed by Cosmos Infraestate Pvt. Ltd. and launched in 2010, consists of four residential towers. Possession was given in phases Tower D in 2015, Tower B in 2016, and Towers A and C in 2017. However, mandatory occupancy certificates (OC) and completion certificates (CC) have not been issued, leaving buyers unable to legally register their properties.


The delay stems from pending lease rent dues of approximately INR 1.8 crore owed by the developer to the UP State Industrial Development Authority (UPSIDA). Authorities have made it clear that registry processing would only begin once all dues are cleared and required certificates are submitted. Between 2020 and 2025, UPSIDA issued over 15 notices to the developer warning about pending payments and compliance issues.

In December last year, UPSIDA escalated the matter by writing to the district magistrate for recovery of dues as government arrears. Following this, the Dadri tehsildar issued a recovery certificate against Cosmos Infraestate. The authority also took punitive action by sealing nine unsold flats and halting further sale or purchase of units in the project.

Residents report that the lack of registered sale deeds and necessary certificates has caused severe financial and legal difficulties. Many cannot secure loans from banks, sell their flats, or obtain approvals from local civic authorities. Questions have been raised about why possession was handed over without ensuring the mandatory regulatory clearances.

Buyers who filed complaints on the government grievance portal said that in a review meeting in January, the developer assured authorities that all pending dues would be cleared and the required OC and CC documents would be submitted by March. Yet, many residents remain skeptical, citing repeated unfulfilled commitments from the developer over the years.

The developer, through company manager Arvind Kumar Singh, stated that discussions with UPSIDA are ongoing. Technical discrepancies in dues calculation, previously estimated at over INR 80 lakh, are being resolved, and efforts are underway to initiate registries as soon as possible. Residents continue to monitor developments closely, hoping for a definitive resolution after years of delays.
