The Delhi State Consumer Disputes Redressal Commission recently ruled against a real estate developer for project delays. This decision concerns a housing project located in Andhra Pradesh, holding the developer liable and ordering financial compensation due to significant delays in delivering promised units to homebuyers.


The commission found DLF Gayatri Developers responsible for the project's extended delay. It ordered the developer to refund INR 15 lakh to the complainant. An additional INR 1.5 lakh was awarded to the complainant to cover mental distress and legal expenses. The complainant had booked a flat in October 2012, with possession assured within 24 months, meaning by October 2014. However, possession was only offered in 2019, resulting in an eight-year delay.

The complainant paid approximately 75% of the total amount by September 2013. The developer attributed the delay to the Telangana movement in Andhra Pradesh and the time taken for various statutory approvals. They also claimed the complainant had defaulted on payments and refused to sign the allotment letter.

However, the commission rejected these arguments, holding DLF Gayatri Developers accountable for the delay. The ruling stated that the developer had no right to hold onto the complainant's money and was responsible for arranging labor for the project.
