Residents of Chandigarh protested at Sukhna Lake against the suspension of share-wise property transfer in the city. The Chandigarh administration issued a notification in March 2023, halting the transfer of properties on a share-wise basis. This has caused difficulties for property owners who are unable to sell or purchase their shares. The Chandigarh Property Shareholders' Welfare Association members expressed their intention to pursue contempt proceedings against the officers of the administration and send a legal notice for contempt of court orders.
Last week, residents of Chandigarh gathered at Sukhna Lake to protest the suspension of share-wise property transfer in the city. Since the Chandigarh administration issued a notification in March 2023, the transfer of properties on a share-wise basis has been halted, causing difficulties for property owners who are unable to sell or purchase their shares.
The Chandigarh Property Shareholders' Welfare Association members expressed their intention to pursue contempt proceedings against the officers of the Chandigarh administration. They plan to take legal action and send a legal notice for contempt of court orders.
Advocate Sushil Ghai, who had filed a writ requesting the publication of minutes from the heritage committee meeting, stated his plans to initiate contempt proceedings. According to him, the heritage committee had previously affirmed that there was no need for changes in the Chandigarh Masterplan 2031 or the 2017 bylaws, and that the old status quo should be maintained. He further asserted that the deputy commissioner lacked the authority to amend the estate rules of the Union Territory.
Various property-related associations have been raising objections to the suspension of share-wise transfer for several days. They have met with senior officials of the Chandigarh administration and political leaders to address the issue. However, the administration has not yet responded to the protests. The outcome regarding whether the administration will lift the suspension on share-wise property transfer remains uncertain.
The future of share-wise property transfer in Chandigarh is currently unclear. The Chandigarh administration has not responded to the protests, leaving open the possibility that the suspension may be lifted. However, it is also conceivable that the administration may take further measures to restrict share-wise property transfer.
