The Supreme Court has declined to halt the Dharavi redevelopment project in Mumbai, currently undertaken by Adani Properties Pvt Ltd. The court issued notices to the Maharashtra government and Adani Properties following a petition by Seclink Technologies Corporation, which challenged a previous Bombay High Court decision upholding the project's tender process. Seclink, initially the highest bidder in 2018, had its tender scrapped, leading to Adani's successful bid in 2022. Seclink offered to increase its bid by 20%, but the court did not stay the project. Adani has commenced work, employing around 2,000 people. The Supreme Court has directed Adani to process all project-related payments through a single bank account, with the next hearing scheduled for the week of May 25.
The Supreme Court recently declined to halt the ongoing Dharavi redevelopment project in Mumbai, which is being executed by Adani Properties Pvt Ltd. A bench led by Chief Justice Sanjiv Khanna issued notices to the Maharashtra government and Adani Properties Pvt Ltd, seeking their responses to a petition filed by UAE-based Seclink Technologies Corporation. This petition challenges a December 20, 2024, verdict of the Bombay High Court that upheld the tender awarded to the Adani Group for the project, ruling there was no "arbitrariness, unreasonableness or perversity" in the decision.
Seclink Technologies Corporation had initially emerged as the highest bidder for the project in 2018 with its INR 7,200-crore offer, but the tender was later scrapped by the government. Subsequently, in 2022, Adani Properties Pvt Ltd secured the 259-hectare Dharavi redevelopment project with a bid of INR 5,069 crore. Seclink challenged this decision, but the Bombay High Court dismissed their plea, leading to the current appeal in the Supreme Court.
During the recent hearing, Seclink's senior advocate, C Aryama Sundaram, urged the court to order a status quo and expressed willingness to increase their original bid by 20 per cent, bringing it to INR 8,640 crore. However, the bench declined to stay the project at this stage. Solicitor General Tushar Mehta, representing the Maharashtra government, questioned whether Seclink was prepared to meet all additional obligations required in the new tender. Meanwhile, senior advocate Mukul Rohatgi, appearing for Adani Properties, emphasised that work on the project had already begun, funds had been deposited, and about 2,000 people were employed in the redevelopment efforts.
The Supreme Court has directed Adani Properties Pvt Ltd to ensure that all project-related payments are processed through a single bank account for transparency. The matter is scheduled for further hearing in the week of May 25.
The Supreme Court's decision to allow the continuation of the Dharavi redevelopment project underscores the judiciary's recognition of the project's significance and the procedural integrity upheld by the Bombay High Court. The directive for Adani Properties Pvt Ltd to maintain a single bank account for project-related payments ensures financial transparency.
