Mumbai: KDMC registers case against five developers for illegal construction in Kalyan Taluka

Synopsis

The Kalyan-Dombivli Municipal Corporation (KDMC) has lodged a case against five developers at the Kalyan Taluka Police Station under the Maharashtra Regional and Town Planning (MRTP) Act for the unauthorised construction of chawl rooms in Kalyan Taluka. The individuals identified in the case are Kitabullah Sheikh, Baitullah Sheikh, Mukhlish Kabadi, Iftikhar Kabadi, and Zulfiqar Khaliq. Complaints were received regarding illegal constructions in the Manda and Balyani areas, following which KDMC issued notices demanding legal documentation. As the accused failed to present valid land records and permissions, two FIRs were registered against them under the MRTP Act.

The Kalyan-Dombivli Municipal Corporation (KDMC) has filed a case against five developers at Kalyan Taluka Police Station under the Maharashtra Regional and Town Planning (MRTP) Act for engaging in illegal construction of chawl rooms in Kalyan Taluka.


The developers named in the case include Kitabullah Sheikh, Baitullah Sheikh, Mukhlish Kabadi, Iftikhar Kabadi, and Zulfiqar Khaliq.

According to Pramod Patil, KDMC's A Ward Officer, these individuals carried out unauthorised construction in the Manda and Balyani areas of Kalyan Taluka, which prompted multiple complaints from residents.

KDMC officials stated that upon receiving a formal complaint, they issued notices to the developers, instructing them to submit relevant land records and approval documents.

Officials further mentioned that when the accused were unable to provide any valid documentation, two FIRs were registered against them under the MRTP Act. This case highlights KDMC's commitment to enforcing legal measures against unauthorised developments, safeguarding regulated urban growth.

The Maharashtra Regional and Town Planning (MRTP) Act, 1966, serves as a legal framework to regulate unauthorised developments. Sections 52, 53, 54, and 55 of the Act empower authorities to take legal action against unlawful constructions and order their demolition. Essentially, if any structure is built without proper authorisation, the planning authority has the right to act against it as per the provisions of the MRTP Act.
