In Bengaluru, the start of the new year saw significant disruptions in property transactions and registrations, caused by confusion over the transfer of 90 sub-registrars. Many buyers and sellers visited sub-registrars' offices, hoping to complete their property transactions. However, the transfer-related confusion caused issues in at least 10 sub-registrar offices across the city.
Sources from the Gandhinagar sub-registrar office mentioned that property registrations were halted due to a dispute between two sub-registrars over the position. Neither had the necessary system login ID to process property transactions, causing a backlog.
The issue stemmed from a transfer order issued by the state government on December 10, which moved 90 senior sub-registrars to different locations across Bengaluru. Some of the incumbent sub-registrars contested these transfers, arguing that the orders were issued at an inconvenient time, disrupting their daily routines. By that point, 32 of the 90 sub-registrars had already started working at their new posts, but they were forced to return to their original locations due to an interim order by the High Court. This left the newly transferred sub-registrars without clear roles, contributing to further confusion.
In response, the transferred sub-registrars reached out to the department for assistance. According to sources, the state government consulted the Advocate-General (AG), who advised that login IDs should be provided to the newly transferred sub-registrars. However, the sub-registrars had not yet received these login IDs, preventing them from performing their duties and affecting the functioning of several sub-registrar offices.
This disruption is not the first of its kind. Previous years have seen similar issues arising from mid-year transfers of sub-registrars, leading to administrative confusion. These disruptions typically result in delays in property transactions, causing inconvenience for both buyers and sellers. Additionally, the lack of timely registration often incurs additional costs or logistical complications.
Moreover, the situation reflects a broader trend of legal challenges concerning government employee transfers. Past instances have highlighted how contradictory court orders can complicate the resolution of such issues, especially when orders are stayed or altered midway. This not only affects the employees but also creates difficulties for the public who rely on smooth administrative processes for their property dealings.
KA Dayananda, the Inspector General of Registration and Commissioner of Stamps, explained that the issue arose due to contradictory court orders. One order had stayed the transfers of 32 officers, while another had directed the provision of login IDs for certain transferees. To resolve this contradiction, the department sought the AG's opinion. The official confirmed that all sub-registrars have since been given their login IDs, although the previous sub-registrars are not cooperating due to the pending court orders. He reassured that the issue would be resolved promptly to avoid further inconvenience to the public.
