Synopsis

The Department of Town and Country Planning (DTCP) in Gurugram has cancelled the occupation certificates (OCs) for 81 houses in DLF Phase 5 for breaching building codes, zoning laws, and approved plans. These properties, originally designated for the economically weaker section (EWS), were found to have exceeded construction limits, with some buildings extending to five or six floors instead of the approved three or four. Many were also being used for illegal commercial purposes. This move follows an earlier survey by the district town planner, which led to notices and sealing actions for over 100 houses.

The Department of Town and Country Planning (DTCP) has recently revoked the occupation certificates (OCs) for 81 houses in DLF Phase 5, citing serious regulatory violations. These properties were found to have significantly breached building codes, zoning regulations, and the approved plans. The revoked OCs apply to houses located on lanes C-1, C-2, C-4, C-5, C-6, and C-7, as mentioned in the official DTCP order. Originally, these properties were allocated under the economically weaker section (EWS) category, which allowed a maximum area of 60 square yards.


This crackdown follows a survey carried out earlier by Manish Yadav, the former district town planner (DTP) for enforcement. During the survey in November, over 100 houses were issued notices, and sealing operations were conducted to address violations. Amit Madholia, the current DTP (enforcement), explained that action to revoke the OCs was taken based on Yadav's recommendations, as part of the department's efforts to address illegal activities in EWS-designated housing.

The violations identified in these properties include unauthorized construction exceeding the permissible limits. In many cases, buildings had expanded to five or six floors, whereas the regulations only allowed three or four floors. Additionally, some properties were found to have 100% coverage, which breaches zoning rules.

Several of these houses were also being used for illegal commercial activities, prompting swift intervention from the authorities. In response, the DTCP has instructed the Wazirabad tehsildar to refrain from registering these properties or processing any gift deeds and rent agreements. As a result, these properties will be marked with "red entries" in official records.

Furthermore, a formal communication will be sent to the deputy commissioner of Gurgaon and the Wazirabad tehsil office to halt any further registration activities related to these properties. The DTCP also plans to inform the Punjab and Haryana High Court, where a related petition is pending, about the action taken.

Praveen Chauhan, the DTP (planning), emphasized that this action aims to restore compliance with building norms and eliminate unauthorized commercial use in residential areas. This move is part of ongoing efforts by the Gurugram authorities to enforce planning regulations and curb the illegal commercialization of residential properties in upscale areas like DLF Phase 5. The revocation of OCs serves as a stern warning to those who disregard zoning laws and misuse residential spaces for commercial purposes.
