The Department of Town and Country Planning (DTCP) has begun issuing occupation certificates (OCs) for stilt plus four floor buildings constructed without approved plans after a year and a half delay. A government order in February 2023 had restricted four-storey buildings without proper permissions, leaving over 100 structures incomplete. In response, the Haryana government introduced a regularization policy in July, allowing buildings to secure OCs with an additional fee. Processing faced delays due to a High Court stay, which was lifted last month, allowing DTCP to resume on a priority basis. This progress has brought relief to property owners awaiting compliance and recognition for their investments.
Following a delay of a year and a half, the Department of Town and Country Planning (DTCP) has started issuing occupation certificates (OCs) for stilt-plus-four-floor (S+4) buildings that were constructed without approved plans. An official mentioned that the district town planner (planning) has received around 50 applications to date, with 25 OCs already granted. For the remaining buildings, demand notices have been issued, and the OCs will be provided once the required fees are paid. Some applications are still under review, the official added.
A government order issued on February 23, 2023, restricted the construction of four-storey buildings without proper approvals, resulting in numerous structures in licensed colonies being left unfinished and without occupation certificates (OCs). Many of these buildings were initially approved for only two or three storeys, but owners added a fourth floor, leaving over 100 structures without the required permissions. To address this, the Haryana government introduced a regularization policy on July 2, permitting such buildings to secure OCs by paying an additional fee within a 60-day period.
The issue faced further delays due to a lawsuit in Punjab and Haryana High Court. Last month, however, with the High Court lifting its stay, the district town planner (DTP) resumed processing pending applications on a priority basis, aiming to provide long-awaited relief to building owners. Over the past month and a half, the department has received approximately 50 applications. Each application undergoes a thorough inspection, including checks for any complaints from neighbours, before OCs are issued. Some applications have been granted OCs, while others are pending fee payments or additional documentation due to ongoing review and compliance requirements.
DTP (planning) Praveen Chauhan stated that all regularization applications are being processed within the specified timelines, with most of the received applications already resolved. He noted that pending cases are currently under review, with property owners being advised on required documentation and fee payments. This expedited issuance of occupation certificates represents a notable shift, bringing long-awaited compliance and reassurance to building owners in Gurgaon's real estate sector.
The recent actions by the Department of Town and Country Planning (DTCP) mark a significant step forward for property owners of stilt plus four floor buildings awaiting occupation certificates. After prolonged delays caused by regulatory restrictions and court lawsuits, DTCP's resumed processing of applications offers much needed clarity and resolution. The issuance of occupation certificates, underpinned by a regularization policy and a structured approval process, not only addresses compliance issues but also restores stability to affected building owners. This progress reflects the government's efforts to balance regulatory compliance with property owner needs, bringing a sense of security and formal recognition to these properties in Gurgaon.
