The Department of Town and Country Planning (DTCP) in Gurugram has directed the Garden Estate RWA to monitor and report all structural works after inspections revealed unauthorised alterations by residents. Officials warned that both individual homeowners and the RWA could face legal action if violations go unchecked. While some residents support strict enforcement to ensure safety and planning discipline, others argue that minor internal changes should not be penalised. Authorities said the move aims to strengthen transparency and compliance by making RWAs accountable. Clearer guidelines distinguishing serious structural breaches from internal modifications may help balance safety with resident flexibility.Read more

The Telangana government is set to amend the Indian Stamp Act and Registration Act to plug revenue leakages from property auctions by banks and financial institutions. Buyers of auctioned properties will now be required to pay full stamp duty on transaction value, ending the practice of using only a "sale certificate" to bypass payments. A new Section 22-B of the Registration Act will also empower officials to cancel fraudulent registrations made through forgery, impersonation, or double sales-authority currently limited to courts. The amendments, requiring presidential assent, align with measures in states like Andhra Pradesh and Tamil Nadu and are expected to safeguard revenue while curbing property fraud.Read more

The Supreme Court has directed a man to vacate two properties in Mumbai and hand them back to his 80-year-old father. The order was passed after the son was found preventing his father and mother, aged 78, from residing in their own homes. A tribunal had earlier ruled in favour of the parents, ordering eviction of the son and a monthly maintenance of INR 3,000. While the Bombay High Court had later overturned this decision, the apex court had restored the tribunal's order, confirming that such authorities are empowered under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 to ensure the rights and welfare of senior citizens.Read more

The Allahabad High Court's Lucknow bench has expressed concern over a single bench order that stayed the demolition of an illegal building in Khurram Nagar. The division bench has summoned the records to examine the urgency of the petition, which was filed under Article 226 rather than Article 227 of the Constitution. The matter stems from a 2016 public interest litigation, involving repeated violations of demolition orders by the builder. The next hearing is scheduled for later this month, with directives to the Lucknow Development Authority (LDA) to ensure accountability.Read more

The Karnataka High Court recently struck down a 2020 circular issued by the Karnataka Real Estate Regulatory Authority (K-RERA) that sought to retrospectively impose a delay fee on real estate developers for late submission of quarterly updates and annual audit statements. The court highlighted that such fees require legislative backing and cannot be imposed solely through administrative orders. The judgment reflects the importance of statutory authorization in financial regulations and provides relief to developers who faced penalties without clear legal sanction.Read more
