Bihar RERA recently secured the refund of INR 14.23 lakh to two homebuyers from Aryavart Lifespaces Private Limited, following cases transferred to the Patna district administration under the Bihar and Orissa Public Demand Recovery Act, 1914. The Act allows authorities to confiscate property and issue warrants against defaulters. A meeting, led by RERA Bihar chairman Vivek Kumar Singh, focused on expediting these cases and developing a monitoring system, including a mobile app for tracking progress. Additionally, plans to auction Agrani Homes Pvt Ltd's confiscated land via an e-proc platform were discussed, aiming to reimburse aggrieved homebuyers.
Bihar's Real Estate Regulatory Authority (RERA) has successfully facilitated the refund of INR 14.23 lakh to two homebuyers. This amount was recovered from a defaulting promoter and returned under the provisions of the Bihar and Orissa Public Demand Recovery Act (PDRA), 1914. The refunded sums were INR 7.38 lakh to Kiran Sharma and INR 6.85 lakh to Sudhir Sharma, both from Aryavart Lifespaces Private Limited. This success underscores the efforts of RERA Bihar in ensuring that aggrieved homebuyers receive their due refunds.
The PDRA Act empowers certificate officers with broad authority to confiscate properties and issue warrants against defaulters, providing a mechanism for recovering dues. The recent refunds were highlighted during a meeting convened by RERA Bihar Chairman Vivek Kumar Singh, which included officials from the district administration responsible for handling PDRA cases. The primary agenda of the meeting was to expedite the resolution of PDRA cases referred by RERA, focusing on those where promoters had failed to refund money to homebuyers.
RERA Bihar member S.D. Jha and other senior officials also participated in this meeting. Special Officer (Rationing) of Patna district, Manoranjan Kumar, detailed the refunds and confirmed that both homebuyers had received their money, leading to the closure of these specific cases.
Chairman Singh emphasised the need for a monitoring system to oversee the progress of PDRA cases. He proposed the development of a mobile application to facilitate this process. This app would enable district administration personnel to enter case progress reports online, allowing for regular tracking and ensuring transparency and accountability in handling such cases. Singh highlighted that continuous monitoring would significantly aid in achieving the goal of refunding money to aggrieved homebuyers.
In addition to these measures, the meeting addressed the upcoming auction of 27 'kattha' of land belonging to Agrani Homes Pvt Ltd. This land, located in the Dhawalpura locality of Patna, has been confiscated by RERA. The auction process, set to commence after June 15, will be conducted using the e-proc platform to ensure complete transparency. The proceeds from this auction will be distributed among the affected homebuyers, offering them a resolution to their grievances.
Furthermore, RERA Bihar is exploring a proposal to have its certificate officer handle public demand recovery cases more efficiently. Currently, these cases are referred to the district administration, with around 800 cases referred so far. The authority's aim is to speed up the disposal of these cases to provide quicker relief to homebuyers.
