Former Indian cricketer Yuvraj Singh has issued two legal notices to Delhi-based real estate firms, M/s Brilliant Etoile Private Limited and M/s Uppal Housing Private Limited, via Rizwan Law Associates. The first notice addresses delays in delivering a promised high-quality apartment in Hauz Khas, New Delhi, seeking damages for the delay and substandard quality. The second notice targets Brilliant Etoile Private Limited for infringing his privacy and intellectual property rights, alleging unauthorised use of his image and brand for promotion beyond the expiration of their Memorandum of Understanding (MoU) on November 23, 2023. Yuvraj demands cessation of these uses and compensation for damages.
Former Indian cricketer Yuvraj Singh has initiated legal proceedings against two Delhi-based real estate firms, M/s Brilliant Etoile Private Limited and M/s Uppal Housing Private Limited, through Delhi-based law firm Rizwan Law Associates. Singh's grievances encompass both the delay in the delivery of a promised apartment and the alleged misuse of his personal brand and image.
The first legal notice targets both companies and concerns the delayed possession of a dwelling unit that Singh had booked in 2020 in Hauz Khas, New Delhi. The cricketer had anticipated a premium quality apartment but was reportedly offered a significantly inferior one. The notice demands "adequate damages" for the delay in completing the project and issuing the Letter of Possession, citing the absence of any reasonable cause or extension in the timeline. Furthermore, it insists on the "delivery of proper quality, standard, class and grade" of the apartment as originally promised to Singh.
In addition to the quality and delay issues, the second legal notice, directed solely at M/s Brilliant Etoile Private Limited, addresses the alleged infringement of Singh's privacy rights and unauthorised commercial exploitation of his image. This notice claims that despite the expiration of the Memorandum of Understanding (MoU) on November 23, 2023, which outlined the terms for Singh to promote and endorse the project, the company continued to use his photographs and brand for promotional purposes. These uses included displaying his image on billboards, the project site, social media posts, and articles, which Singh argues is a violation of his Intellectual Property Rights, including his Copyright, Personality Rights, and Right to Publicity.
The legal notice highlights that this continued usage of Singh's image and services breach the agreed terms of the MoU, which specifically governed the extent and duration of his promotional commitments. Singh's legal representatives assert that this unauthorised usage not only breaches contractual obligations but also exploits his personal brand value without due consent, thereby causing reputational and financial harm.
The former cricketer's legal action seeks not only to cease the continued misuse of his image but also to secure compensation for the damages incurred. The notice elaborates that Singh reserves the right to detail further instances of these violations in the Statement of Claim, suggesting that the current allegations may be expanded upon in subsequent legal documentation.
These legal actions underscore the broader issues of accountability and adherence to contractual commitments within the real estate sector, particularly concerning high-profile clients. Singh's case highlights the potential for significant disputes when promised deliverables, whether related to property quality or contractual promotional obligations, are not met. The outcome of these legal notices could set a precedent for similar cases involving celebrity endorsements and real estate transactions, emphasising the need for clear and enforceable agreements between parties.
