Residents of Castenlino Building in Vile Parle offered alternative housing by developer

In a significant legal development, the owner of Castelino Building in Vile Parle gaothan, Romell Real Estate Private Limited, has assured the Bombay High Court that alternative accommodation will be arranged for its four tenants before proceeding with the planned demolition for redevelopment.



The Brihanmumbai Municipal Corporation (BMC) had taken drastic measures by disconnecting water and electricity supplies to Castelino Building citing its dangerous condition. Subsequently, the court delivered a crucial order, stating that tenancies should not be terminated merely due to the hazardous or dilapidated condition of a building.



In a firm declaration, the court remarked, "It is unacceptable for the owner of the property to simply let the tenanted structure remain dilapidated or be brought down and to do absolutely nothing for its reconstruction or redevelopment." This remark aligns with a recent judgment emphasizing the responsibility of property owners to maintain or redevelop structures, underscoring the court's commitment to safeguarding tenants' rights.



In compliance with the High Court's directive, the tenants occupying the ground plus one storey building, categorized as C1, are now obligated to vacate the premises by February 5. C1 buildings, classified as dilapidated and dangerous, necessitate immediate evacuation. To facilitate this transition, the court has instructed the Municipal Corporation to reinstate basic services during the interim period.



Romell Real Estate Private Limited, the owner of Castelino Building, has submitted a commitment to the court, assuring that alternative accommodation with an equal carpet area will be provided to the tenants. Furthermore, the owner has presented the possibility of granting ownership of flats to the tenants if the building undergoes redevelopment. It is noteworthy that these four families have been residing in Castelino Building since the 1960s, having migrated from Goa. Currently, only two families continue to occupy the structure, underscoring the long-standing nature of their tenancy and the complexity of the redevelopment process.
