Delhi court issues NBW against promoters of Greenopolis in Gurugram

Synopsis

A non-bailable warrant (NBW) has been issued against Surpreet Singh Suri, the promoter of Three C Shelters Private Limited, by a Delhi court, after he failed to appear in court for a hearing related to the delayed Greenopolis housing project in Gurugram. The project was launched in 2011 and was supposed to be delivered to buyers in 2015, but not a single unit has been delivered to date. The case is being heard in the Economic Offences Wing (EOW) of Delhi Police, and the next hearing is scheduled for August 29, 2023.

A non-bailable warrant (NBW) has been issued against Surpreet Singh Suri, the promoter of Three C Shelters Private Limited, by a Delhi court, after he failed to appear in court for a hearing related to the delayed Greenopolis housing project in Gurugram. The project was launched in 2011 and was supposed to be delivered to buyers in 2015, but not a single unit has been delivered to date. According to homebuyers in the Greenopolis housing project, when the case was first herd in Saket District Court of Chief Metropolitan Magistrate Shivani Chauhan, none of the none of the accused builders were present in the court. Their absence agitated the bench, who warned the representing advocates that if the accused builders do not appear in person in the hearing, the bail granted to them would be cancelled, and NBW will be issued to secure their physical presence in court. However, accused Surpreet Singh Suri still failed to appear in court. Following which the judge cancelled the bail.



In 2018, over 100 allottees of the Greenopolis project filed criminal complaints with the EOW of Delhi Police against the accused builders for financial fraud, alleging that they had collected INR 1,155 crore from the allottees but failed to deliver homes to them. The housing project was being developed jointly by Two Promoters ? Three C Shelters Pvt Ltd and Orris Infrastructure Pvt Ltd. Homebuyers allege that the promoters kept pushing the blame for the delay in completion upon each other, all at the cost of the homebuyers.



Dipika Mohil, Vice-President, Greenopolis Welfare Association, said that in 2019, the homebuyers approached Haryana Real Estate Regulatory Authority who directed the builder to restart the construction work. The builder restarted the work but stopped again after some time. In June 2020, the promoter Three C went to National Company Law Tribunal (NCLT) to declare insolvency. In July 2020, the National Consumer Disputes Redressal Commission (NCDRC) ordered Three C Shelters Pvt Ltd and Orris Infrastructure to refund around INR 12 crore, along with interest.
