Jharkhand High Court panel conducts building inspections in Jamshedpur

A three-member panel appointed by the Jharkhand High Court carried out an investigative visit to Jamshedpur on a recent Sunday, focusing on inspecting residential and commercial structures within the Jamshedpur Notified Area Committee (INAC) boundaries. The primary purpose of this unannounced visit was to ascertain whether the Jharkhand Municipal Act regulations had been adhered to and whether the Building Bylaws of 2016 were followed.

During their visit, the panel examined various buildings to determine if there were any discrepancies between the actual structures and the building plans previously approved by the JNAC. Additionally, the panel also scrutinized whether parking areas in these buildings had been unlawfully transformed into commercial spaces. The panel comprised Raj Nandan Sahay, Sudarshan Shrivastava, and Neeraj Pandey, and they conducted their investigations in several locations, including Bistupur, Sakchi, and other parts of the INAC jurisdiction.

A member of the panel members, stated that the findings from their inspection would be presented before the court, and their examination would continue in the coming days. The panel has been entrusted with the responsibility of submitting a comprehensive report to the court within a timeframe of six weeks.

It is worth noting that the High Court established this panel of lawyers in response to a Public Interest Litigation (PIL) filed by Rakesh Jha in 2019. Jha's petition alleged that approximately 1,246 structures within the INAC area, constructed after 1998, flagrantly violated building bylaws and Municipal Act regulations.

The panel's formation occurred on September 30, 2023, by the bench headed by Chief Justice Sanjay Kumar Mishra and Justice Anand Sen. It is important to recall that in 2011, the court had proactively taken notice of buildings constructed on encroached government land and those that had been erected in defiance of the Municipal Act's provisions. On both February 28 and July 11, 2011, the court issued orders to all districts to address these issues and take appropriate actions.
