A case of alleged cheating and criminal intimidation has surfaced in Visakhapatnam, where the widow of an Army officer filed a complaint against the promoters of GCON BUILDER, a private real estate company. According to the complaint, the family had purchased a duplex flat from the builder, but the project was delayed multiple times without proper communication. Suspecting a discrepancy in the flat's actual area, the family consulted an architect who confirmed a significant difference. When the family confronted the builder, they were met with intimidation and threats. The complaint has been registered, and the police have initiated an investigation into the matter under relevant sections of the Indian Penal Code.
A prominent case of alleged cheating and criminal intimidation has emerged in Visakhapatnam as the widow of an Army officer, Chetti Lakshmi Bhai, filed a complaint against Gottumukkala Satyanarayana Raju and Gottumukkala Sivaram, the promoters of GCON BUILDER, a private real estate company. The complaint was registered with the Three-Town police station in Vizag city.
According to the widow's statement, her son, Ch Jagan, had purchased a residential duplex flat from GCON Builder in October 2018. The builders had assured the family that the project would be completed by 2019. However, as the promised completion date came and went, Jagan did not receive possession of the flat.
The aggrieved family was taken aback by the builder's lack of communication regarding the delay. Eventually, the possession date was extended to July 2020, causing further distress and uncertainty. The registered sale deed document indicated that the flat's overall area was approximately 2,884 square feet, with a carpet area (net usable area) of 1,997 square feet.
Suspecting a discrepancy in the actual carpet area, Chetti Lakshmi Bhai decided to consult a licensed architect. The architect's evaluation revealed a significant disparity, as the actual carpet area was found to be only 1,785.72 square feet. Armed with this information, the widow and her son approached the builder seeking an explanation for the alleged deficiency in service and potential fraud.
Instead of addressing their concerns, the builder, along with his manager, Murali K Nipani, resorted to intimidation tactics, threatening the family with severe consequences if they persisted with their demands. Undeterred by these threats, Chetti Lakshmi Bhai remained determined to seek justice and promptly lodged a complaint with the Three-Town police station.
Sub-inspector S Santosh Kumar confirmed the registration of a case against GCON Builder under Sections 420 (cheating) and 506 r/w 34 (criminal intimidation) of the Indian Penal Code (IPC). The police have pledged to meticulously examine all relevant documentary evidence in order to conduct a thorough investigation into the matter.
