The Noida Authority is moving forward with plans to reclaim 13 acres of a 24-acre land parcel in Sector 144 that was originally allocated to the Unitech Group for residential development in 2011. Despite the passage of over a decade, no construction has commenced on the land. According to officials, this specific plot is not involved in the ongoing Supreme Court case concerning Unitech's unfinished projects, which clears the way for the Authority to cancel its allotment.
The decision to reclaim the land was made during the Authority's most recent board meeting, though officials have stated that they will seek approval from the Supreme Court before taking possession. The land in question was part of a 1 lakh square metre parcel allotted to Unitech in March 2011, but the developer did not take possession until 2015. That same year, Unitech requested that the parcel be divided, subsequently subleasing 11 acres to the Gulshan Group, which completed two housing projects on that portion of the land.
However, the remaining 13 acres have remained vacant, and Unitech has accumulated dues amounting to INR 392.8 crore as of April 2024. Under the terms of the lease deed, Unitech was expected to complete its projects on the Sector 144 plot by July 2022. The official noted that as no projects were launched on that land, there were no homebuyers associated with it.
The delay in developing the Sector 144 plots is largely attributed to a Supreme Court case filed in 2016, which addressed Unitech's numerous unfinished projects and led to the arrest of the company's former promoters. In 2019, the Supreme Court dissolved Unitech's management and appointed a government-approved group of directors to oversee the completion of the developer's unfinished projects. This new management team took charge in 2020.
Importantly, the two plots totaling 13 acres are not referenced in the Supreme Court's April 2024 order, which directed the Noida Authority to approve the layouts for Unitech projects where homebuyers had already been allotted flats. Currently, around 5,500 homebuyers are waiting to take possession of their flats and villas in Unitech projects across Sectors 96, 97, 98, 113, and 117.
The Supreme Court has yet to make a final decision regarding the Noida Authority's intention to reclaim the vacant land parcels allocated to Unitech. The developer had proposed constructing new towers and plotted houses on these vacant areas as a means to generate capital and resources necessary to complete its unfinished projects, but the Authority opposed this proposal.
In the meantime, the Noida Authority remains firm in its position, highlighting its commitment to reclaiming land that has remained undeveloped for years. The outcome of this situation will depend on the Supreme Court's forthcoming decisions, which will determine whether the Authority can proceed with its plans to take back the land and potentially reallocate it for other purposes.
